Severe events may cause physical damage to the facility or even destruction beyond repair.
وقد تؤدي أحداث شديدة الخطورة الى الحاق أضرار مادية بالمرفق أو حتى الى تدميره الى درجة يتعذر معها اصلاحه .

2. The contracting authority shall have the power to agree to make direct payments to the concessionaire as a substitute for, or in addition to, tariffs or fees for the use of the facility or its services.
2- يكون للسلطة المتعاقدة الصلاحية في الاتفاق على اجراء دفعات مباشرة إلى صاحب الامتياز، كبديل عن التعريفات أو الرسوم على الانتفاع بالمرفق أو خدماته، أو اضافة اليها.

Acts that do not involve specific targeting of health facilities may also violate the right to health where the acts increase the risk of damage to the facility or decrease patient access to it, such as by locating military outposts or weapons in the vicinity of a clinic.
والأفعال التي لا تنطوي على استهداف محدد للمرافق الصحية قد تشكل أيضا انتهاكا للحق في الصحة، حيث تزيد الأعمال من خطر الأضرار التي تلحق بالمرفق أو تعوق وصول المرضى إليه، مثل وضع مواقع عسكرية أو أسلحة في المنطقة المجاورة لعيادة.

121. The Commission accepted that proposition and agreed to include a second paragraph in the draft model provision to the effect that the contracting authority should have the power to agree to make direct payments to the concessionaire as a substitute for, or in addition to, tariffs or fees for the use of the facility or its services.
121- وقبلت اللجنة ذلك الاقتراح واتفقت على إدراج فقرة ثانية في مشروع الحكم النموذجي تقضي بأن تخول إلى السلطة المتعاقدة الصلاحية للموافقة على تسديد دفعات مباشرة إلى صاحب الامتياز كبديل عن الرسوم أو التعريفات على الانتفاع بالمرفق أو الخدمات التي يقدمها، أو إضافة إلى تلك الرسوم أو التعريفات.

122. In order to avoid the impression that the draft model provision created a peremptory right of the concessionaire to charge, receive or collect tariffs or fees for the use of the facility or its services, the Commission agreed to combine the two sentences of paragraph 1.
122- ومن أجل تجنّب الانطباع بأن مشروع الحكم النموذجي ينشئ حقا قطعيا لصاحب الامتياز لكي يفرض أو يتقاضى أو يحصِّل تعريفات أو رسوم على الانتفاع بالمرفق أو الخدمات التي يقدمها، اتفقت اللجنة على الجمع بين جملتي الفقرة 1.

1. The concessionaire shall have the right to charge, receive or collect tariffs or fees for the use of the facility or its services in accordance with the concession contract, which shall provide for methods and formulas for the establishment and adjustment of those tariffs or fees [in accordance with the rules established by the competent regulatory agency].
1- يتعين أن يكون لصاحب الامتياز الحق في فرض أو تقاضي أو تحصيل تعريفات أو رسوم على الانتفاع بالمرفق أو خدماته وفقا لعقد الامتياز الذي يجب أن ينص على طرائق وصيغ لإرساء تلك التعريفات أو الرسوم وتعديلها [وفقا للقواعد التي تضعها الهيئة الرقابية المختصة].(41)

He therefore proposed that the model provision should read: " The concessionaire shall have the right to charge, receive or collect tariffs or fees for the use of the facility or the services it provides, in accordance with the concession contract, which shall provide for methods and formulas for the establishment and adjustment of those tariffs or fees " .
واقترح بالتالي أن يصاغ الحكم النموذجي على النحو التالي: " يكون لصاحب الامتياز الحق في فرض أو تقاضي أو تحصيل تعريفات أو رسوم على الانتفاع بالمرفق أو الخدمات التي يقدمها، وفقا لعقد الامتياز، الذي يتعين أن ينص على طرائق وصيغ لتحديد تلك التعريفات أو الرسوم وتعديلها " .

وقد تؤدي أحداث شديدة الخطورة الى الحاق أضرار مادية بالمرفق أو حتى الى تدميره الى درجة يتعذر معها اصلاحه )للاطلاع على مناقشة للعواقب القانونية لوقوع مثل هذه اﻷحداث، انظر الفصل الرابع " تشييد البنية التحتية وتشغيلها " ، الفقرات ١٣١ الى ٩٣١(.
