In relation to claims for vehicles, the Panel reviewed a motor vehicle valuation table submitted by the Government of Kuwait that lists the value of a wide range of motor vehicles in Kuwait as at 1 August 1990.

In addition, for claims relating to termination indemnities, the Panel verifies that the individuals receiving payments were employees of the claimant at the time of Iraq’s invasion and occupation of Kuwait, by reference to employment contracts, payroll records or other appropriate documentary evidence.

With regard to the claims for termination indemnities, the Panel finds that the claim of Dar Al-Watan For Press, Printing & Publication is not compensable, as the amount paid by the claimant to its employees was not shown to be an incremental cost to the claimant.
76- فيما يتعلق بالمطالبات المتصلة بتعويضات إنهاء العقود، يرى الفريق أن مطالبة دار الوطن للصحافة والطباعة والنشر غير قابلة للتعويض، نظراً إلى أن المبلغ الذي دفعه صاحب المطالبة لموظفيه غير مبين على أنه تكلفة زائدة لصاحب المطالبة.

15. Article 1(1)(m) permits arrest only in respect of claims for " wages of masters, officers or crew " .

With respect to claims for decline in business leading to loss of profits or claims for increased costs, the Panel notes that such losses in this instalment were suffered over extended periods of time, and that such losses were generally spread over the period of loss.

With respect to claims for real and tangible property damage occurring as a result of the invasion of Al Khafji, military operations in the Eastern Province and as a result of scud missile attacks, the Panel determined that the date of loss is 7 February 1991. /
31- وقرر الفريق، فيما يتعلق بالمطالبات المتصلة بخسائر الممتلكات العقارية والمادية المتكبدة نتيجة لغزو مدينة الخفجي والعمليات العسكرية في المنطقة الشرقية ونتيجة الهجمات بقذائف " سكد " ، أن تاريخ الخسارة هو 7 شباط/فبراير 1991(31).

However, for all claimant groups, certain exceptional circumstances after 2 March 1991 warranted recovery of compensation for injuries and compensation has been recommended accordingly.In connection with claims for personal injury where no date of injury was provided, the Panel determined that a review of the claims should be conducted to ascertain whether dates had inadvertently been omitted from the claim forms.

With respect to claims for increased employment costs, the Panel recalls the findings in its previous reports that salary payments made to unproductive employees are compensable " to the extent that the lack of productivity was a direct result of Iraq's invasion and occupation of Kuwait ... and the employee could not be reassigned to other productive tasks " .
154- فيما يتعلق بالمطالبات المتصلة بازدياد تكاليف التشغيل، يذكر الفريق بالنتائج التي توصل إليها في تقاريره السابقة وهي أن المرتبات المدفوعة للموظفين غير المنتجين قابلة للتعويض " إذا ما كان نقص الإنتاجية نتيجة مباشرة لغزو العراق واحتلاله للكويت ... وعدم إمكان إعادة تكليفهم بمهام أخرى منتجة " (92).

With respect to claims for increased employment costs, the Panel recalls the findings in its previous reports that salary payments made to unproductive employees are compensable " to the extent that the lack of productivity was a direct result of Iraq's invasion and occupation of Kuwait ... and the employee could not be reassigned to other productive tasks " .

With respect to the claims relating to meetings held in Yugoslavia and Iraq, the costs which appear to the Panel to be properly attributable to Iraq's invasion and occupation of Kuwait are the costs attributable to the meetings of August 1990, October 1990 and 28 January 1991.
267- وفيما يتعلق بالمطالبات المتصلة بالاجتماعات المعقودة في يوغوسلافيا والعراق، يتبين للفريق أن التكاليف التي يمكن عزوها لغزو العراق واحتلاله للكويت بصورة مقبولة هي تكاليف الاجتماعات المعقودة في شهر آب/أغسطس 1990 وشهر تشرين الأول/أكتوبر 1990 وفي 28 كانون الثاني/يناير 1991.

18. According to media reports, in August 2009 Guam's delegate introduced a bill (H.R. 3379) in the United States Congress to " amend the Radiation Exposure Compensation Act to include the Territory of Guam in the list of affected areas with respect to which claims relating to atmospheric nuclear testing shall be allowed " .

During the ninety-second session of the IMO Legal Committee, some delegations underlined that since problems related to wreck removal were mostly encountered in the territorial sea, States parties should benefit from the mandatory international insurance provisions of the convention with regard to Claims Concerning wreck removal in that zone.
