With respect to the claims for lost profits of the vessels seized and detained in Kuwait during the hostilities, the Panel finds that the appropriate measure of compensation is the profits that the claimants would have earned for the period of time reasonably required to render the vessels operational.

Similarly, with respect to claims for loss of use of real property, in the present instalment, claimants have normally lost the ability to use property for which they had contracted and paid rent at 2 August 1990 and, accordingly, the Panel adopts this as the date of loss for such claims.

With respect to claims for costs associated with containers that were stranded in ports, the Panel finds that such costs are compensable to the extent that the claimant shows that the containers could not be delivered to their consignees in Iraq or Kuwait because of the invasion and occupation of Kuwait and that it incurred such costs.
190- وفيما يتعلق بالمطالبات عن التكاليف المرتبطة بالحاويات التي تُركت في الموانئ، يرى الفريق أن هذه التكاليف قابلة للتعويض في حالة إثبات صاحب المطالبة تعذر تسليم الحاويات إلى الجهات المرسلة إليها في العراق أو الكويت بسبب غزو واحتلال الكويت وأنه تكبد هذه التكاليف.
