With respect to treaties over time, his delegation favoured the position that subsequent practice which was contradicted by the practice of any other party to a treaty should be discounted in order to preserve the fundamental principle of consent, by ensuring that States were not bound by actions by which they had not intended to be bound.

His delegation noted that the Commission was preparing to consider two topics -- the most-favoured-nation clause and treaties over time -- with the goal of producing, not draft articles according to its usual methodology, but studies, specifically, eight papers on the most-favoured-nation clause and a " repertory of practice " on treaties over time.

With regard to treaties over time, his delegation maintained its previously stated position, namely that work on the topic should aim only to strengthen and complement -- but under no circumstances to modify -- the treaty regime established under the 1969 Vienna Convention on the Law of Treaties.

34. With regard to treaties over time, his delegation fully supported the Study Group's intention to complete its discussions on the introductory report prepared by the Chair of that Group by 2011 and to start the second phase of its work.
