The Republic of Lithuania Law on the Legal Status of Aliens was adopted on 29 April 2004 and came into force on 30 April 2004.

Prior to the adoption of the new law, issues relating to the legal status and asylum of aliens were regulated by two separate laws: the Republic of Lithuania Law on Refugee Status and the Republic of Lithuania Law on the Legal Status of Aliens.

171. The Committee is concerned by the new Law on the Legal Status of Aliens which restricts considerably the possibility for asylum-seekers to be granted refugee status and only provides them with humanitarian protection (art. 5).

The State had the sovereign right to expel aliens from its territory if they had committed a crime or an administrative offence; if their actions had violated its legislation on the Legal Status of Aliens or threatened the security of State or public order; or if the expulsion was necessary for the protection of the life, health, rights or legitimate interests of its nationals.
49 - وأضاف قائلا إن للدولة الحق السيادي في طرد الأجانب من أراضيها إذا ارتكبوا جريمة أو مخالفة إدارية؛ أو إذا انتهكت أفعالهم تشريعاتها المعنية بالوضع القانوني للأجانب أو هددت أمن الدولة أو النظام العام؛ أو إذا كان الطرد ضروريا لحماية حياة أو صحة أو حقوق مواطنيها أو مصالحهم المشروعة.

33. The Government reported that the Law on the Legal Status of Aliens contained special provisions concerning unaccompanied children, and that State authorities were obliged to take into account their best interests, to ensure the protection of their interests and to locate their family members as soon as possible or appoint guardians.
33 - وأبلغت الحكومة أن القانون المتعلق بالوضع القانوني للأجانب يتضمن أحكاما خاصة بشأن الأطفال غير المصحوبين، وأن سلطات الدولة مجبرة على مراعاة مصالحهم الفضلى، وضمان حماية مصلحتهم، وتعقب أفراد أُسرهم بالسرعة الممكنة، أو تعيين أوصياء عليهم.

(8) The Committee welcomes the information provided by the delegation that the Law on the Legal Status of Aliens (Aliens Law) has been amended in November 2006 and that asylum-seekers are now exempt from detention, even in cases where they enter or stay illegally in the State party.
(8) ترحب اللجنة بالمعلومات التي أتاحها الوفد بشأن تعديل القانون المتعلق بالوضع القانوني للأجانب (قانون الأجانب) في تشرين الثاني/نوفمبر 2006، وبشأن إعفاء ملتمسي اللجوء في الوقت الحاضر من الاحتجاز حتى في الحالات التي يدخلون فيها إلى الدولة الطرف أو يقيمون فيها بصورة غير شرعية.

UNHCR recommended that Lithuania review and amend the Law on the Legal Status of Aliens to address issues related to family unity.
وأوصت المفوضية ليتوانيا بإعادة النظر في القانون المتعلق بالوضع القانوني للأجانب وتعديله بغية معالجة المسائل المرتبطة بلم شمل الأسرة(82).

The Law on the Legal Status of Aliens (2008) provided for the Foreigners' Registration Centre to serve as the only facility for all asylum-seekers during the processing of asylum claims.
فالقانون المتعلق بالوضع القانوني للأجانب (2008) ينص على وجود مركز لتسجيل الأجانب يكون بمثابة المرفق الوحيد لاستقبال جميع طالبي اللجوء أثناء عملية معالجات طلبات اللجوء.

Please also indicate how many women have been granted temporary residence permits, pursuant to article 26 of the law on the Legal Status of Aliens (2008), for having cooperated with prosecutors, describing the situation of those women after their temporary permits have expired and that of victims who do not wish to cooperate with the authorities.

30. The Government of Lithuania reported that article 3 (2) of the Law on the Legal Status of Aliens of the Republic of Lithuania (Official Gazette, 2004, No. 73-2539) confirmed the principle that non-nationals were equal before the law, irrespective of their sex, race, nationality, language, origin, social status, religion, convictions or views.
30 - أبلغت حكومة ليتوانيا أن المادة 3 (2) من القانون المتعلق بالوضع القانوني للأجانب في جمهورية ليتوانيا (الجريدة الرسمية، 2004، العدد رقم 73-2539) تؤكد المبدأ القائل بأن الأشخاص من غير المواطنين متساوون أمام القانون، بغض النظر عن الجنس أو العرق أو الجنسية أو اللغة أو المنشأ أو الوضع الاجتماعي أو الدين أو المعتقد أو الرأي.

32. Amendments to the Law on the Legal Status of Aliens had been drafted in order to implement directive 2008/115/EC of the European Parliament and of the Council of 16 December 2008, on common standards and procedures in member States for returning illegally staying third-country nationals (Official Journal of the European Union L 348, 24.12.2008, pp. 98-107).
32 - وقد تمت صياغة تعديلات لإدخالها على القانون المتعلق بالوضع القانوني للأجانب وذلك بقصد تنفيذ التوجيه 2008/115/EC للبرلمان الأوروبي وللمجلس الأوروبي المؤرخ 16 كانون الأول/ديسمبر 2008 بشأن المعايير والإجراءات الموحدة في الدول الأعضاء من أجل إعادة رعايا بلدان ثالثة يقيمون بشكل غير قانوني (الجريدة الرسمية للاتحاد الأوروبي OJL348, 24. 21.2008، الصفحات 98-107).

In this connection, a number of amendments were to be introduced into national legislation, in particular, in the law on the Legal Status of Foreigners and stateless persons, the law on migration and the new law on refugees and persons who are in need of additional temporary protection in Ukraine.
وفي هذا الصدد، يزمع إدخال عدد من التعديلات على التشريعات الوطنية، ولا سيما القانون المتعلق بالوضع القانوني للأجانب والأشخاص عديمي الجنسية، وقانون الهجرة، والقانون الجديد المتعلق باللاجئين والأشخاص الذين يحتاجون إلى حماية مؤقتة إضافية في أوكرانيا.

The Draft Law on the Legal Status of Foreigners reads that a foreigner shall not be deported from the Republic of Lithuania to the country where he/she will be exposed to torture, cruel and inhuman treatment or humiliation of his/her dignity, or will be punished in this manner i.e. where the non-repatriation principle is applicable to him/her.
وينص مشروع القانون المتعلق بالوضع القانوني للأجانب على أنه لا يجوز ترحيل أجنــبي من جمهوريــــة ليتوانيــــا إلـــى بلــــد يكون عُرضة فيه للتعذيب، أو المعاملة القاسية وغير الإنسانية، أو الإهانة لكرامته، أو تتم فيه معاقبته بهذا الأسلوب، أي حيث يكون مبدأ عدم الإعادة إلى الوطن منطبقا عليه.
