118. This recommendation reflects the current practice of the Tribunal and is reflected in the Directive on Assignment of Defence Counsel.
118 - هذه التوصية تمثل الممارسة التي تأخذ بها المحكمة حاليا، وقد وردت في التوجيه المتعلق بانتداب محامي الدفاع.

The directive on the Assignment of Defence Counsel sets out the conditions and procedure for the Assignment of Counsel to indigent suspects and accused.
ويحدد التوجيه المتعلق بانتداب محامي الدفاع شروط وإجراءات انتداب المحامي للمشبوه أو المتهم المعوز.

As noted above, the Registrar is given the responsibility under the Rules of the Tribunal to assign counsel to suspects and accused, and the regulations regarding these matters are set forth in the Directive on Assignment of Defence Counsel.

At its third plenary session held at The Hague on 5 July 1996, the Tribunal completed its rules of procedure and evidence and adopted the directive on the Assignment of Defence Counsel and the rules governing the detention of persons awaiting trial or appeal before the Tribunal or detained on its orders.

In accordance with the articles on the remuneration for defence counsel as indicated in the Directive on Assignment of Defence Counsel approved by the Tribunal on 9 January 1996, certain conditions and procedures have been established by the Tribunal for determining indigence and access to defence counsel.

52. According to the Directive on the Assignment of Defence Counsel, the Tribunal conducts means tests to verify the financial positions of the suspects and accused individuals, and the test results are used to determine whether and to what extent they are entitled to receive legal aid.

During a plenary session held on 15 December 2000, upon the initiative of the Registrar, the judges of the Tribunal approved an amendment to the Directive on Assignment of Defence Counsel that allows the Registry to pay only a portion of the costs incurred by the representation of an accused when the accused possesses the means to remunerate counsel in part.
وخلال جلسة عامة عُقدت في 15 كانون الأول/ديسمبر 2000، بناء على مبادرة من المسجل، وافق قضاة المحكمة على إدخال تعديل على التوجيه المتعلق بانتداب محامي الدفاع يمكّن قلم المحكمة من دفع قسط فحسب من التكاليف المتكبدة لتمثيل متهم ما إذا كانت لهذا الأخير إمكانية دفع جزء من أتعاب المحامي.

In accordance with the Directive on Assignment of Defence Counsel, the resources requested would provide for counsel to any accused found unable to provide his/her own legal representation (requirements of indigence as defined in article 4 of the Directive).
