In accordance with article 2 of the Convention, any person commits an offence if that person by any means, directly or indirectly, unlawfully and wilfully, provides or collects funds with the intention that they should be used or in the knowledge that they are to be used, in full or in part, in order to carry out:

Under section 5 paragraph 1, a person who directly or indirectly provides or collects funds with the intention that they should be used or in the knowledge that they are to be used to finance a serious offence mentioned in paragraph 1, subparagraphs 1 to 5, shall be sentenced for the offence in question.

The CTC would like to draw the attention of Tonga to sub paragraph specifically criminalizing the wilful provision or collection of funds, financial assets or economic resources by its nationals and or entities in its territory, by any means, directly or indirectly, with the intention that they should be used in order to carry out terrorist acts.

Effective implementation of paragraph 1 requires that, in accordance with the International Convention, there are provisions in place specifically criminalizing the wilful provision or collection, by any means, directly or indirectly, of funds by the nationals of Belarus or in its territory with the intention that the funds should be used, or in the knowledge that they are to be used, in order to carry out terrorist acts.
