2.4 On 3 March 1996, the Aliens Police Department of the Györ Border Guards Directorate issued an expulsion order against the author.
٢-٤ وفي ٣ آذار/ مارس ١٩٩٦، أصدرت إدارة شرطة شؤون اﻷجانب في مديرية حرس حدود غيور أمر طرد بحق صاحب البلاغ.

4.7 In conclusion, the State party notes that there is no reason to challenge the judicial decisions against the author and that the author did not file any complaint with the ProcuratorGeneral concerning the alleged unlawfulness of his sentence.
4-7 وختاماً، تلاحظ الدولة الطرف أنه ليس هناك داع للطعن في الأحكام القضائية الصادرة بحق صاحب البلاغ وأن صاحب البلاغ لم يقدم أي شكوى لدى النائب العام فيما يتعلق بادعاء عدم مشروعية الحكم الصادر بحقه.

On 27 April 2004, the Centre Province Court of Appeal upheld the judgement against the author.
وفي 27 نيسان/أبريل 2004، أكدت محكمة الاستئناف للمنطقة الوسطى الحكم الصادر بحق صاحب البلاغ.

The State party's authorities are looking into the different possibilities to ensure the enforcement of this sentence against the author given his continued detention in Iraq.

In the absence of a satisfactory explanation from the State party, the Committee considers that the facts reveal a violation of article 7 of the Covenant, with respect to the author.

It submits that in October 2005 the author received a presidential pardon and returned to his home country.

Under these circumstances, the Committee finds that, in the present case, the obligation to pay a deposit does not impair either the author's right of access to a court or his right to an effective remedy.
وفي ظل هذه الظروف، ترى اللجنة أن التزام دفع مبلغ الإيداع لا يخل في هذه القضية لا بحق صاحب البلاغ في اللجوء إلى محكمة ولا بحقه في سبيل انتصاف فعال.

4.2 The State party submit that while in 1972 the Plzen District Court sentenced the author for illegally emigrating from the Republic of Czechoslovakia (he was rehabilitated under a legislation passed in 1990), he has never been deprived of his citizenship.
4-2 وتقول الدولة الطرف إنه بالرغم من أن المحكمة المحلية في بلزن أصدرت حكماً عام 1972 بحق صاحب البلاغ بسبب هجرته غير القانونية من جمهورية تشيكوسلوفاكيا (رُد له الاعتبار بموجب قانون اعتمد عام 1990)، فإنه لم يحرم أبداً من جنسيته.
