2. The recommendation of the International Insolvency Institute is that UNCITRAL take a position of leadership in developing a higher use of systems such as cross-border insolvency protocols and Guidelines for Court-to-Court Communications in transnational insolvency cases to promote better results for reorganizing debtors, their suppliers, their creditors, their employees and, ultimately, the public interest in the countries involved.

At its fortieth session (2007), the Commission considered a preliminary report (A/CN.9/629) on the outcome of consultations with judges and insolvency practitioners to collect experience with respect to negotiating and using cross-border insolvency protocols and, in particular, a draft outline of possible notes on cross-border cooperation, including cross-border protocols, that was attached to the preliminary report.

4. One tool for facilitating cross-border cooperation and coordination is the cross-border protocol. Guidance on the negotiation and use of cross-border protocols is the core of the work proposed.

That consideration would be based upon document A/CN.9/WG.V/WP.76/Add.1 and should take into account issues of postcommencement and post-application finance, as well as cross-border protocols.

Some of the issues to be addressed in the introduction would include examining the grounds on which courts defer to decisions of other courts; identifying different matters required to be brought before respective courts; seeking common ground between the parties involved; and providing examples of judicial cooperation in action, particularly with respect to the use of cross-border protocols.
