رابعاً- نتائج المناقشة المشتركة بشأن الاتجار بالممتلكات الثقافية التي أجراها فريق الخبراء الحكوميين العامل المعني بالمساعدة التقنية والفريق العامل المعني بالتعاون الدولي

(a) UNODC should develop a model framework legislation on trafficking in cultural property.
(أ) ينبغي للمكتب أن يضع إطاراً تشريعاً نموذجياً بشأن الاتجار بالممتلكات الثقافية.

Guideline 43. States should consider concluding bilateral or multilateral agreements or arrangements in order to establish joint investigative teams for trafficking in cultural property and related offences.
المبدأ التوجيهي 43 - ينبغي للدول أن تنظر في إبرام اتفاقات أو ترتيبات ثنائية أو متعددة الأطراف من أجل إنشاء أفرقة تحقيق مشتركة بشأن الاتجار بالممتلكات الثقافية وما يتصل به من جرائم.

(g) Promotion of data exchange and information-sharing to increase the information available with respect to trafficking in cultural property at the global level.
(ز) تشجيع تبادل البيانات والمعلومات لزيادة المعلومات المتوفرة بشأن الاتجار بالممتلكات الثقافية على الصعيد العالمي.

A number of speakers referred to emerging areas of crime such as environmental crime and trafficking in cultural property, and welcomed the opportunity to hold a thematic debate on trafficking in cultural property during the upcoming session of the Commission on Crime Prevention and Criminal Justice.

(ج) إنشاء قواعد بيانات وطنية بشأن الاتجار بالممتلكات الثقافية وما يتصل بذلك من جرائم/الممتلكات الثقافية المصدَّرة أو المستوردة بصورة غير مشروعة أو المسروقة أو المنهوبة أو المتاجر بها بصورة غير مشروعة أو المفقودة، أو تحسين قواعد البيانات الموجودة؛

In accordance with resolution 5/7 of the Conference of the Parties to the United Nations Convention against Transnational Organized Crime, the recommendations and outcomes of the meetings of the expert group were examined at the joint discussion on trafficking in cultural property of the Working Group of Government Experts on Technical Assistance and the Working Group on International Cooperation held during the sixth session of the Conference.
8- ووفقاً لقرار مؤتمــر الأطراف فــي اتفاقيــة الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية 5/7، دُرست التوصيات والنتائج المنبثقة عن اجتماعات فريق الخبراء في المناقشة المشتركة بشأن الاتجار بالممتلكات الثقافية التي أجراها فريق الخبراء الحكوميين العامل المعني بالمساعدة التقنية والفريق العامل المعني بالتعاون الدولي، التي عُقدت خلال دورة المؤتمر السادسة.

(c) Establishing or improving national databases, as appropriate, on trafficking in cultural property and related offences and on trafficked, illicitly exported or imported, stolen, looted, illicitly excavated or illicitly traded or missing cultural property;
(ج) إنشاء قواعد بيانات وطنية بشأن الاتجار بالممتلكات الثقافية وما يتصل به من جرائم وبشأن الممتلكات الثقافية المتاجر بها أو المصدرة أو المستوردة بصورة غير مشروعة أو المسروقة أو المنهوبة أو المستخرجة بصورة غير مشروعة أو المتاجر بها بصورة غير مشروعة أو المفقودة، أو تحسين قواعد البيانات الموجودة، حسب الاقتضاء؛

The Assembly also requested UNODC to reconvene the expert group on protection against trafficking in cultural property for Member States to review and revise the draft guidelines for crime prevention and criminal justice responses with respect to trafficking in cultural property, with a view to finalizing and submitting them to the Commission at its twenty-third session.
وطلبت الجمعية إلى المكتب أيضا أن يدعو مرة أخرى إلى عقد اجتماع لفريق الخبراء المعني بالحماية من الاتجار بالممتلكات الثقافية لكي تستعرض الدول الأعضاء مشروع المبادئ التوجيهية لتدابير منع الجريمة والعدالة الجنائية بشأن الاتجار بالممتلكات الثقافية وتنقحه، بغرض وضع تلك المبادئ في صيغتها النهائية وتقديمها إلى اللجنة في دورتها الثالثة والعشرين.
