At the global policy level, besides discussions on marine genetic resources of areas beyond national jurisdiction by the General Assembly Ad Hoc Informal Working Group, work has been ongoing to promote the entry into force and implementation of international instruments addressing a number of issues related, generally, to genetic resources.

In the absence of the agreed consensual elements referred to in paragraph 6 (a) of the format and annotated agenda for the eighth meeting (A/AC.259/L.8), the co-chairpersons, in the annex to the report, proposed possible elements on marine genetic resources to be suggested to the General Assembly for consideration under its agenda item " Oceans and the law of the sea " .

254. FFA noted the need for a legal study on marine genetic resources beyond areas of national jurisdiction to determine, particularly, whether these resources are part of the common heritage of mankind in the Area or whether they form part of the regime of the high seas.

Following on the discussions on marine genetic resources at the eighth meeting, the Assembly encouraged States and international organizations to continue to support, promote and strengthen capacity-building activities, especially in developing countries, in the field of marine scientific research, taking into account in particular the need to create greater taxonomic capabilities.
