(1) During the discussion of draft guideline 2.1.7, some members of the Commission considered that purely and simply applying the rules it establishes in the case of a reservation that was manifestly " impermissible " gave rise to certain difficulties.

In particular, they stressed that there was no reason to provide for a detailed examination of the formal validity of the reservation by the depositary, as is done in the first paragraph of draft guideline 2.1.7, while precluding him from reacting in the case of a reservation that is manifestly impermissible.

The Special Rapporteur recalled that, with the possible exception of draft guideline 2.1.8 on " Procedure in case of manifestly [impermissible] reservations " , the Sixth Committee favourably welcomed the draft guidelines adopted at the fifty-fourth session.

13. Draft guideline 2.1.8 (Procedure in case of manifestly invalid reservations) gave rise to concern, for it inappropriately extended the functions of the depositary.
13 - وتطرّق إلى مشروع المبدأ التوجيهي 2-1-8 (الإجراء المتخذ في حالة تحفّظات غير مشروعة بصورة بيِّنة) فقال إنه يثير قلقاً إذ يؤدي بصورة غير ملائمة إلى توسيع وظائف الوديع.

The Commission had addressed the issue in another context, namely in the discussion of draft guideline 2.1.8 [2.1.7 bis] " Procedure in case of manifestly [impermissible] reservations " , in which it had not been possible to agree on the word " impermissible " , with the result that the words " inadmissible " and " invalid " had been proposed as alternatives.
