In such cases, the Committee recalls that under article 4, paragraph 2, of the Optional Protocol, when receiving a new communication registered by the Committee for consideration under the Optional Protocol, States parties are under an obligation to cooperate by submitting to it written explanations or statements clarifying the matter and indicating the measures, if any, that may have been taken to remedy the situation.
وفي هذه الحالات، تذكّر اللجنة بأنه بموجب الفقرة 2 من المادة 4 من البروتوكول الاختياري، عندما تتلقى الدول الأطراف بلاغاً جديداً مسجلاً من اللجنة من أجل النظر فيه بموجب البروتوكول الاختياري، تكون الدول الأطراف ملزمة بالتعاون مع اللجنة بأن تقدم إليها خطياً إيضاحات أو بيانات توضح المسألة وتبين، عند الاقتضاء، التدابير التي كان من الممكن اتخاذها لتصحيح الوضع.

When the secretariat receives a new communication which prima facie meets all the admissibility criteria and contains a reasonable level of substantiation, it prepares a summary of the facts and the complaint for the Special Rapporteur, who then decides whether or not the communication should be registered and transmitted to the State party for its observations.
4- عندما تتلقى الأمانة بلاغاً جديداً يستوفي مبدئياً جميع معايير المقبولية ويشتمل على حد معقول من الأدلة، تُعدّ الأمانة موجزاً بشأن الوقائع والشكوى وتقدمه إلى المقرر الخاص الذي يبت حينها فيما إذا كان ينبغي أم لا تسجيل البلاغ وإحالته إلى الدولة الطرف كي تعرب عن آرائها بشأنه.

In the follow-up report (CCPR/C/80/FU1), adopted by the Committee during its eightieth session, neither the Special Rapporteur on new communications nor the Special Rapporteur on follow-up to Views considered the author's submission to pertain to follow-up, but was in fact a new communication and should be dealt with in the ordinary way.
وفي تقرير المتابعة (CCPR/C/80/FUI) الذي اعتمدته اللجنة في دورتها الثمانين، اعتبر كل من المقرر الخاص المعني بالبلاغات الجديدة والمقرر الخاص المعني بمتابعة الآراء أن رسالة صاحب البلاغ لا تتصل بالمتابعة بل إنها تُشكل في الواقع بلاغاً جديداً ومن ثم ينبغي تناولها في إطار الإجراء العادي.
