36. In light of the above, courts and tribunals should play a key role in the elimination of laws and practices that discriminate against women.

48 The trust that societies and women themselves may have in the judiciary is essential if courts and tribunals are to be responsive to women's needs and protect women's human rights.

28. The organization and functioning of the courts and tribunals satisfy the great standards of international justice, that is, equality before the law without any discrimination, independence and impartiality of the judiciary, the presumption of innocence, legality of offences and penalties, the double hearing principle, and the right to a defence, assistance and legal aid.
28- وتستوفي كيفية تنظيم وسير عمل المحاكم بمختلف درجاتها المعايير الأساسية الدولية، وهي التساوي أمام القانون دونما تمييز، واستقلال القضاء ونزاهته، ومبدأ توافر أركان المخالفات وشرعية العقوبات، والحق في الاستئناف، وكذلك الحق في الاستعانة بمحام وفي الحصول على مساعدة قضائية.

25. The courts and tribunals are organized and operate in conformity with the highest international standards of justice, namely, equality before the law without discrimination, the independence and impartiality of the judiciary, the presumption of innocence, the legality of criminal offences and penalties, the appeal system, the right to a defence and legal assistance and aid.
25- وتستوفي كيفية تنظيم المحاكم بمختلف درجاتها وسير عملها معايير العدل الأساسية الدولية، وهي التساوي أمام القانون دون تمييز واستقلال القضاء ونزاهته وافتراض البراءة وتحديد المخالفات والعقوبات قانوناً ومبدأ التقاضي على درجتين والحق في الاستعانة بمحام وفي المساعدة القضائية.

In this regard, the Special Rapporteur welcomes efforts by international and regional courts and tribunals for the inclusion of adequate gender representation as a criterion for the selection of judges.

In its Decision No. 94 of 2011, the Council of Ministers approved the implementing mechanism for the absorption, in 2011, of 25 per cent of the total number of registered jobseekers holding various levels of university degrees and technological, technical and vocational diplomas who had applied for civil service employment before the end of 2010.
