وإن عدم أخذ الدول الأطراف في اعتبارها التزاماتها القانونية فيما يتعلق بالحق في العمل لدى إبرام اتفاقات ثنائية، أو متعددة الأطراف مع دول أخرى ومنظمات دولية وكيانات أخرى كالكيانات المتعددة الجنسيات، يشكل انتهاكاً لالتزامها بمراعاة الحق في العمل.

States parties are under the obligation to respect the right to work by, inter alia, prohibiting forced or compulsory labour and refraining from denying or limiting equal access to decent work for all persons, especially disadvantaged and marginalized individuals and groups, including prisoners or detainees, members of minorities and migrant workers.
23- الدول الأطراف مُلزمة بمراعاة الحق في العمل عن طريق جملة أمور من بينها حظر السخرة أو العمل الإجباري، وعدم حرمان أحد من الحق في تكافؤ الفرص في الحصول على عمل لائق أو تقييد هذا الحق، ولا سيما بالنسبة إلى المحرومين والمهمشين من أفراد ومجموعات، وكذلك السجناء أو المحتجزين()، وأفراد الأقليات والعمال المهاجرين.
