86- وإذا كان على السلطات العامة والمنظمات التي تتخذ قرارات تهم الأطفال أن تتصرف وفقاً لواجب تقييم مصالح الطفل الفضلى وتحديدها، فإنه لا يُتوقع من الأشخاص الذين يتخذون القرارات التي تهم الأطفال يومياً (مثل الوالدين والأوصياء والمعلمين وغيرهم) أن يتبعوا بدقة هذا الإجراء المكون من خطوتين، وإن كان يجب أيضاً أن تتقيد القرارات المتخذة في الحياة اليومية بمصالح الطفل الفضلى وتجسدها.

(a) An integrated approach would include interventions that impact indirectly on parents' ability to promote the best interests of children (e.g. taxation and benefits, adequate housing, working hours) as well as those that have more immediate consequences (e.g. perinatal health services for mother and baby, parent education, home visitors);
(أ) فإذا اتُبع نهج متكامل فإنه سيشمل عمليات تدخّل تؤثر بصورة غير مباشرة على قدرة الوالدين على النهوض بمصالح الطفل الفضلى (مثلاً الضرائب والمزايا، والإسكان الملائم، وساعات العمل) فضلاً عن عمليات التدخل التي يكون لها آثار أكثر مباشرة (مثلاً توفير الخدمات الصحية في فترة ما حول الولادة للأم والطفل، وزيارات الرعاية المنزلية)؛

Adopted in 1989, the Convention on the Rights of the Child recognizes the child as a subject of rights that States commit to respect, protect and fulfil, guided by the best interests of the child.

136. As regards the general principle of the best interests of the child under article 3 of the Convention, the Committee is concerned that this principle is not given adequate attention in national legislation and policies and that this principle is not a primary consideration in decisionmaking regarding children, for example custody decisions.
136- في ما يخص المبدأ العام المتعلق بمصالح الطفل الفضلى المنصوص عليه في المادة 3 من الاتفاقية، يساور اللجنة القلق لعدم منح هذا المبدأ الاهتمام الكافي في التشريعات والسياسات الوطنية ولأن هذا المبدأ لا يوضع في المقام الأول عند اتخاذ القرارات المتعلقة بالأطفال، مثل القرارات الخاصة بالحضانة.

The Committee recommends that existing legislation be reviewed so as to make sterilization of mentally disabled children require the intervention of the courts, and that care and counselling services be provided to ensure that this intervention is in accordance with the provisions of the Convention, especially article 3 on the best interests of the child and article 12.
وتوصي اللجنة بأن يعاد النظر في التشريع القائم لجعله يستلزم تدخل المحاكم في مسألة تعقيم الأطفال المعوقين عقلياً، وتوصي بتوفير خدمات الرعاية والارشاد لضمان أن يكون هذا التدخل وفقاً لأحكام الاتفاقية، وبخاصة المادة 3 المتعلقة بمصالح الطفل الفضلى والمادة 12.

518. The Committee recommends that appropriate legislative measures be adopted and implemented with regard to adoption of children, in the light of the principles of the best interests of the child and respect for his or her views and articles 20 and 21 of the Convention.

Through such a dialogue, the Committee would have expected to raise a wider awareness of the way in which armed conflicts affect children, particularly when they are even used as a target for military strategy, and to encourage the consideration of measures guided by the best interests of the child.

20. CRC also urged Djibouti to ensure that inter-country adoption is performed in full compliance with the best interests of the child and that it provides appropriate legal guarantees for children, including non-nationals, throughout the adoption process, in order to avoid possible cases of sale or trafficking of children for adoption or other aims.

The Committee further recommends that the State party continue and strengthen its efforts to ensure that the general principle of the best interests of the child is appropriately integrated in all legal provisions as well as in judicial and administrative decisions and in projects, programmes, and services that have an impact on children.
كما توصي اللجنة الدولة الطرف بأن تواصل وتعزز جهودها لضمان إدراج المبدأ العام المتعلق بمصالح الطفل الفضلى على نحو مناسب في جميع الأحكام القانونية وكذلك في القرارات القضائية والإدارية وفي المشاريع والبرامج والخدمات التي تؤثر في الأطفال.

27. The Committee is concerned that the general principle of the best interests of the child contained in article 3 of the Convention is not fully integrated in national legislation, regulations and practices concerning children.
27- تشعر اللجنة بالقلق لكون المبدأ العام المتعلق بمصالح الطفل الفضلى الوارد في المادة 3 من الاتفاقية غير مدرج بالكامل في التشريعات واللوائح والممارسات الوطنية المتعلقة بالطفل.

As the international community moves forward in the shaping of the global post- 2015 development agenda, Member States' decisive voices and influence are needed to promote an agenda that bridges development and children's rights concerns, and is guided by the best interests of the child.
٤٢- وبينما يمضي المجتمع الدولي قدماً صوب وضع خطة التنمية العالمية لما بعد عام 2015، لا بد من أن تُسمِع الدول الأعضاء أصواتها الحاسمة وأن تمارس نفوذها من أجل النهوض ببرنامج يكون جسراً يصل بين التنمية والشواغل المتعلقة بحقوق الطفل ويسترشد بمصالح الطفل الفضلى.
