128- ينبغي أن ينص القانون على أنه يجب على أي شخص أن يتصرّف بنيّة حسنة وبطريقة معقولة تجاريا لدى إنفاذ حقوقه وأداء التزاماته بمقتضى أحكام هذا القانون التي تحكم الحقوق اللاحقة للتقصير.

1. In addition to exercising the powers conferred upon the President elsewhere by the present rules, the President shall declare the opening and closing of the meeting, preside at the meetings, ensure the observance of the present rules, accord the right to speak, put questions to the vote and announce decisions.
1 - يقوم الرئيس، بالإضافة إلى السلطات المخولة له في مواضع أخرى بمقتضى أحكام هذا النظام، بإعلان افتتاح الاجتماع واختتامه، وبترؤس الجلسات، وضمان مراعاة أحكام هذا النظام، وإعطاء حق الكلمة، وطرح المسائل للتصويت، وإعلان القرارات.

(i) do everything feasible to verify that the objectives to be attacked are neither civilians nor civilian objects and are not subject to special protection but are military objectives within the meaning of paragraph 2 of Article 52 and that it is not prohibited by the provisions of this Protocol to attack them;
`1` أن يبذل قصارى الجهد الممكن للتحقق من أن الأهداف المقرر مهاجمتها ليست أشخاصاً مدنيين أو أعياناً مدنية وأنها غير مشمولة بحماية خاصة، ولكنها أهداف عسكرية بمنطوق الفقرة الثانية من المادة 52، ومن أنه غير محظور مهاجمتها بمقتضى أحكام هذا البروتوكول؛

Elections were held under this Act and the Rehoboth area was governed in terms of the Act until 1989 when the powers granted under the Act were transferred by law to the Administrator General of Namibia in anticipation and in preparation for the independence of Namibia which followed on 21 March 1990.
وأُجريت انتخابات بموجب هذا القانون وحُكمت منطقة ريهوبوث بمقتضى أحكام هذا القانون حتى عام 1989 عندما نُقلت السلطات الممنوحة بموجب هذا القانون إلى الحاكم الاداري العام لناميبيا نقلا قانونيا توقعاً لاستقلال ناميبيا الذي تلا ذلك في 21 آذار/مارس 1999 وإعداداً لهذا الاستقلال.

3. The procuring entity may, in the first stage, engage in discussions with suppliers or contractors whose initial tenders have not been rejected pursuant to provisions of this Law concerning any aspect of their initial tenders.
3- يجوز للجهة المشترية، في المرحلة الأولى، أن تجري مناقشات مع المورِّدين أو المقاولين الذين لم تُرفض عطاءاتهم الأولية بمقتضى أحكام هذا القانون، بشأن أيٍّ من جوانب تلك العطاءات.

2. The Parties undertake that they shall not claim indemnities on an official basis from each other in case of injury, disablement or death of observers as a result of the activities carried out in accordance with the provisions of this document.
٢ - يتعهد الطرفان بعدم مطالبة أحدهما اﻵخر، رسميا، بتعويضات في حالة تعرض المراقبين لﻹصابة أو العجز أو الوفاة نتيجة لﻷنشطة التي تجرى بمقتضى أحكام هذا الاتفاق.

The law should provide that, subject to recommendation 129, the secured creditor may waive unilaterally or vary by agreement any of its rights under the provisions of this law governing post-default rights at any time.
131- ينبغي أن ينص القانون على أنه، رهنا بالتوصية 129، يجوز للدائن المضمون أن يتنازل من جانب واحد عن أي حق من حقوقه بمقتضى أحكام هذا القانون التي تحكم الحقوق اللاحقة للتقصير أو أن يغيرها بالاتفاق.

Liability The law should provide that, if a person fails to comply with its obligations under the provisions of this law governing post-default rights, it is liable to damages.
133- ينبغي أن ينص القانون على أن أي شخص يكون مسؤولاٌ عن دفع تعويض عن الأضرار إذا تخلف عن الامتثال لالتزاماته بمقتضى أحكام هذا القانون التي تحكم الحقوق اللاحقة للتقصير.

(b) Apply to a court or other authority for relief if the secured creditor is not complying with its obligations under the provisions of this law, as provided in recommendation 141;
(ب) التقدم إلى محكمة أو سلطة أخرى بطلب للانتصاف إذا كان الدائن المضمون لا يمتثل لالتزاماته بمقتضى أحكام هذا القانون، وفقا لما هو منصوص عليه في التوصية 141؛

He assumed that the reason for deleting the final phrase of the original version, which read " unless the law of the forum is the applicable law under the provisions of this law on private international law " , was that it could be tacitly understood.
وافترض أن سبب حذف العبارة الأخيرة من الصيغة الأصلية التي تنص على ما يلي " ما لم يكن قانون المحكمة هو القانون المنطبق بمقتضى أحكام هذا القانون المتعلقة بالقانون الدولي الخاص " هو أنه يمكن فهمها ضمنا.

(3) The procuring entity may, in the first stage, engage in discussions with suppliers or contractors whose tenders have not been rejected pursuant to provisions of this Law, concerning any aspect of their tenders.
(3) يجوز للجهة المشترية، في المرحلة الأولى، أن تجري مناقشات مع المورِّدين أو المقاولين الذين لم تُرفض عطاءاتهم بمقتضى أحكام هذا القانون، بشأن أيٍّ من جوانب تلك العطاءات.

(w) Other information required to be included in the record in accordance with the provisions of this Law or the procurement regulations.
(ث) أيَّ معلومات أخرى يلزم إدراجها في السجل بمقتضى أحكام هذا القانون أو لوائح الاشتراء التنظيمية.

2. If an international treaty ratified in the manner prescribed by this Law prescribes norms other than those provided for by laws of the Republic of Armenia, then the norms of the ratified international treaty shall apply.
2- إذا كانت معاهدة دولية مصدق عليها بمقتضى أحكام هذا القانون تنص على معايير أخرى غير تلك المنصوص عليها في قوانين جمهورية أرمينيا، فإن معايير المعاهدة الدولية المصدق عليها تصبح واجبة التطبيق.
