35. The Committee is concerned that children of migrant workers, including Roma children and children of migrant workers in an irregular situation, are often not registered at birth and issued personal identity documents, which impedes their access to health care, social benefits and education.
35- ويساور اللجنة قلق لأن أطفال العمال المهاجرين، بمن فيهم أطفال الروما وأطفال العمال المهاجرين الذين هم في وضع غير نظامي، لا يسجلون غالباً عند الولادة ولا تصدر لهم وثائق الهوية الشخصية، مما يعيق حصولهم على الرعاية الصحية والإعانات الاجتماعية والتعليم.

(a) Take measures to ensure that all children in children's homes, including Roma children, children with disabilities, chronically ill children and multiple siblings are provided with family- and community-based care and that placement in institutional care is used only as a last resort;
(أ) اتخاذ تدابير لضمان حصول جميع الأطفال في دور رعاية الأطفال، بمن فيهم أطفال الروما والأطفال ذوو الإعاقة والأطفال المصابون بأمراض مزمنة والإخوة المتعددون، على الرعاية الأسرية والمجتمعية، والحرص على عدم إيداع الأطفال في مؤسسات الرعاية إلا كملاذ أخير؛

(c) There are barriers to accessing education for children lacking birth registration and identity documents, including Roma children, children with disabilities, children from remote areas and children with HIV/AIDS;
(ج) وجود عوائق تحول دون تعليم الأطفال الذين لا يحملون شهادات ميلاد ووثائق هوية، بمن فيهم أطفال الروما والأطفال ذوو الإعاقة، والأطفال الذين يعيشون في مناطق نائية، والأطفال المصابون بالإيدز والعدوى بفيروسه؛

The Committee notes that the draft law on prohibiting discrimination is awaiting adoption and is concerned that certain groups of children, including Roma children, children of returnees, children without birth certificate, children belonging to minorities and children with disabilities, face de facto discrimination, most importantly with regard to access to education and health care.
وتلاحظ اللجنة أن مشروع قانون حظر التمييز لا يزال في انتظار اعتماده، ويساورها القلق إذ إن بعض الفئات من الأطفال، بمن فيهم أطفال الروما (الغجر) وأطفال العائدين والأطفال بدون شهادات ميلاد والأطفال المنحدرين من أقليات والأطفال ذوي الإعاقة، يواجهون تمييزاً بحكم الواقع، ولا سيما في فرص الحصول على التعليم والرعاية الصحية.

While noting with appreciation policy measures to integrate children belonging to ethnic minorities including Roma children in mainstream education, inter alia, the Roma assistants and the Roma preschool educational projects as well the Strategy of Education of Roma (2004, 2011), the Committee expresses its concern at the following:

The Committee urges the State party to strengthen its efforts to ensure that no child is deprived of the right to education in particular in the rural areas and among the disadvantaged and marginalized groups including the Roma, indigenous peoples and children with disabilities.
تحث اللجنة الدولة الطرف على تعزيز جهودها لضمان عدم حرمان أي طفل من حقه في التعليم ولا سيما أطفال المناطق الريفية والفئات المحرومة والمهمشة، بمن فيهم أطفال الروما والشعوب الأصلية والأطفال المعوقون.
