The Working Group agreed that an informal drafting group should prepare the necessary adjustments to the existing scope of application provisions in order to improve the drafting and to accommodate the inclusion of OLSAs therein.

Further, it was thought that the problem described was less a problem of a State denouncing the previous regime to which it had been a party, and more of an issue of reciprocity, and that if reciprocity regarding other potential Contracting States was a concern, it would be better considered pursuant to the provisions in the draft convention on the scope of application.

It was suggested that while an in-depth discussion of the issue or the choosing of option might be premature, the options presented in the Canadian proposal, in addition to possible other options, should form part of the background paper on scope of application to be presented at a future session of the Working Group.

Subject to the changes mentioned in paragraph 28 above, the Working Group approved the substance of section B.1 on the broad scope of application of the draft annex.

29. The next issue with respect to scope of application and freedom of contract that was considered by the Working Group was the definition of " contract of carriage " , as set out in A/CN.9/WG.III/WP.44.

For the above reasons, the Working Group generally agreed that the text of the draft convention should distinguish between declarations pertaining to the scope of application, which the draft convention admitted and did not subject to a system of acceptances, and objections by other Contracting States, on the one hand, and reservations, on the other hand, which the draft convention did not admit.
31- وللأسباب المذكورة أعلاه، اتفق الفريق العامل عموما على أن نص مشروع الاتفاقية ينبغي أن يميّز بين الاعلانات المتعلقة بنطاق الانطباق التي يسمح بها مشروع الاتفاقية ولا يخضعها لنظام قبول واعتراض من قبل الدول المتعاقدة الأخرى، من جهة، والتحفظات التي لا يسمح بها مشروع الاتفاقية، من جهة أخرى.

41. It was indicated that draft article 5 as set forth in A/CN.9/WG.III/WP.44 operated only in favour of third parties to charter parties and other contracts excluded from the scope of application of the draft instrument, and that draft article 5 could be considered a scope of application provision whose effect was to extend protection to third parties otherwise excluded.
41- أُفيد بأن مشروع المادة 5 بالصيغة الواردة في الوثيقة A/CN.9/WG.III/WP.44 لا يسري إلا لصالح الأطراف الثالثة في مشارطة استئجار وعقود أخرى مستبعدة من نطاق انطباق مشروع الصك، وبأنه يمكن اعتبار أن مشروع المادة 5 حكم خاص بنطاق الانطباق مفعولـه هو مدّ الحماية لأطراف ثالثة تكون مستبعدة خلافا لذلك.
