Mr. Bhagwati commended the United States of America for ratifying the Covenant and also for nominating Mr. Buergenthal, a distinguished jurist and human rights activist who would most certainly be a great asset to the Committee.
٢١ - السيد بهاغواتي: أثنى على الولايات المتحدة اﻷمريكية لتصديقها على العهد، وأيضا لترشيحها السيد بورغنتال، وهو حقوقي مرموق وداعية نشط لحقوق الانسان، ومن المؤكد تماما أنه سيضيف رصيدا كبيرا إلى اللجنة.

Concerning Mr. Bhagwati's question about the number of mentally retarded persons executed since 1972, he said that the Bureau of Justice did not maintain statistics on the mental capacity of persons sentenced to death.

Mr. Bhagwati, while associating himself with the congratulations extended to the Spanish delegation, said he continued to be concerned about the torture and maltreatment of terrorism suspects.

8. Mr. Bhagwati said that, under the existing system, country rapporteurs relied on the assistance of three or four members of the Article 40 Working Group.
٨- السيد بهاغواتي قال إنه في إطار النظام القائم، يعتمد المقررون القطريون على مساعدة الثلاثة أو اﻷربعة أعضاء من الفريق العامل المنشأ بموجب المادة ٠٤.

29. Mr. Bhagwati agreed. There should be no difficulty in appointing both the group of three and the Article 40 Working Group two sessions ahead.

73. Mr. Bhagwati fully endorsed the concerns expressed by his colleagues and urged the Government of Peru to make a serious attempt to implement the Covenant.
٣٧- السيد بهاغواتي قال إنه يشاطر زملاءه كل المخاوف التي أعربوا عنها وحث حكومة بيرو على القيام بمحاولة جدية لتنفيذ العهد.

Mr. Bhagwati asked whether international instruments ratified by Yemen automatically became part of domestic law and thus were enforceable in national courts.
٤١ - السيد بهاغواتي: تساءل إن كانت الصكوك الدولية التي صدقت عليها حكومة اليمن أصبحت تلقائيا جزءا من القانون المحلي ومن ثم قابلة للتنفيذ في المحاكم الوطنية.

It did not include a statistic requested by Mr. Bhagwati - namely, that 36 persons under the age of 18 at the time of arrest had been sentenced to death.
ولم يتضمن اﻹحصاءات التي طلبها السيد بهاغواتي - وبالتحديد، أنه حكم باﻹعدام على ٣٦ شخصا كانوا دون سن ١٨ سنة وقت إلقاء القبض عليهم.

Addressing Mr. Bhagwati's concern about the execution of mentally retarded persons, he said that federal statute prohibited the execution of persons who were mentally retarded or disabled to a degree which prevented them from understanding the nature of the proceedings against them, the nature of the punishment and the reason for its imposition.
وقال بصدد التصدي للقلق الذي عبر عنه السيد بهاغواتي بشأن تنفيذ الحكم باﻹعدام على اﻷشخاص المتخلفين عقليا، إن التشريع البرلماني الاتحادي يحظر تنفيذ الحكم باﻹعدام على اﻷشخاص المتخلفين عقليا أو المعوقين الى درجة تحول دون فهمهم لطبيعة الاجراءات المتخذة ضدهم، وطبيعة العقوبة وسبب فرضها.
