14- وتعرِف المادة 2 من اتفاقية فيينا لقانون المعاهدات " التحفظ " بأنه " إعلان من جانب واحد " ، أيا كانت صيغته أو تسميته، تصدره دولة ما حين توقع معاهدة أو تصدقها أو تقبلها أو تقرها أو تنضم إليها، مستهدفة به استبعاد أو تغيير الأثر القانوني لبعض أحكام المعاهدة في تطبيقها على تلك الدولة " .

25- التحفظ هو إعلان دولة من جانب واحد " تستهدف به استبعاد أو تغيير الأثر القانوني لبعض أحكام المعاهدة في تطبيقها على تلك الدولة " ().
