The law governing the original contract determines the effectiveness of contractual limitations on assignment as between the assignee and the debtor, the relationship between the assignee and the debtor, the conditions under which the assignment can be invoked against the debtor and any question whether the debtor's obligations have been discharged.
يحدد القانون الذي يحكم العقد الأصلي فعالية التقييدات التعاقدية للاحالة فيما بين المحال اليه والمدين، والعلاقة بين المحال اليه والمدين، والشروط التي يمكن بمقتضاها التذرع بالاحالة تجاه المدين، وأية مسألة تتعلق بما اذا كانت التزامات المدين قد أوفيت.

This means that, if the provisions of the draft Convention outside chapter V do not apply with regard to the debtor, the effects of a breach of a contractual limitation on the relationship between the assignee and the debtor are left to the law governing the original contract.
وهذا يعني أنه إذا كانت أحكام مشروع الاتفاقية، خارج الفصل الخامس، لا تنطبق فيما يتعلق بالمدين، فإن آثار انتهاك القيد التعاقدي على العلاقة بين المحال اليه والمدين تكون متروكة للقانون الذي يحكم العقد الأصلي.

Article 6 is intended to apply to agreements between the assignor and the assignee, between the assignor and the debtor or between the assignee and the debtor as long as they vary or derogate from provisions of the draft Convention and not of law applicable outside the draft Convention.
والمقصود أن تنطبق المادة 6 على الاتفاقات بين المحيل والمحال اليه، أو بين المحيل والمدين، أو بين المحال اليه والمدين، طالما كانوا يغيرون أحكام مشروع الاتفاقية، وليس القانون المنطبق خارج اطار مشروع الاتفاقية، أو يخرجون عنه.

Whether the person who received payment may retain it is a matter for article 24, since article 9 limits the effect of the assignment to the relationship between the assignor and the assignee and to the relationship between the assignee and the debtor.
ومسألة ما ان كان يجوز للشخص الذي تلقى السداد أن يحتفظ بالمبلغ المدفوع هي مسألة متروكة للمادة 24، لأن المادة 9 تقصر أثر الاحالة على العلاقة بين المحيل والمحال اليه وعلى العلاقة بين المحال اليه والمدين.
