17. The replies received by the UNCTAD secretariat indicate that financial ship leasing is rarely used in most developing countries.

8. It appears from the replies received to the questionnaire prepared by the UNCTAD secretariat that many developing countries have not planned any form of financial leasing legislation, and have no experience in the leasing of ships.

The subject of ship leasing was of the utmost importance to developing countries, since it provided a shipping company with the entire possession and use of a vessel without capital outlay.
ومضى قائلا إن موضوع تأجير السفن يكتسي أهمية قصوى بالنسبة للبلدان النامية، ذلك أنه يمد شركة النقل البحري بالملكية الكاملة واستخدام السفينة دون إنفاق لرأس المال.

The permanent shortage of capital in most developing countries made ship leasing an attractive alternative to acquiring new ships or replacing ageing fleets.
والنقص الدائم في رؤوس اﻷموال في معظم البلدان النامية يجعل من تأجير السفن حلا بديلا مغريا للحصول على سفن جديدة أو لتبديل اﻷساطيل القديمة.

Information required for the preparation of the report was obtained, inter alia, by sending questionnaires to Governments of developing countries and to law firms and financial institutions involved in ship leasing operations.

19. The replies received also indicate other factors which inhibit ship leasing in developing countries.

This preliminary report is complementary to those earlier reports and therefore does not go into the genesis or operation of financial ship leasing, or into the advantages and drawbacks of the system, risk problems, or any other themes already dealt with.

On the basis of these replies, and the information obtained through other channels, especially the comments made by financial institutions in developed countries, the UNCTAD secretariat suggests that a series of legislative measures should be adopted in order to promote financial ship leasing in developing countries.

18. According to leasing companies, which are usually established in the developed countries, the more significant drawbacks of ship leasing include the risks inherent in the registered ownership of the ship.
٨١- وتفيد شركات التأجير، وهي تقيم عادة في البلدان المتقدمة، بأن من بين أهم العوائق القائمة أمام تأجير السفن اﻷخطار الملازمة لتسجيل ملكية السفينة.

Turkish legislation also requires ship leasing contracts to be registered with the Register of Shipping (Act No. 3226 on Financial Leasing of June 1985).
ويقتضي التشريع التركي أيضا تسجيل عقود تأجير السفن في سجل النقل البحري )القانون رقم ٦٢٢٣ المتعلق بالتأجير التمويلي والصادر في حزيران/يونيه ٥٨٩١(.

Other community norms intended to improve the competitiveness of the merchant marines in the subregion were also under consideration. The principal mechanisms being considered were the establishment of an Andean ship registry, the preparation of legislation to facilitate ship leasing, and the establishment of rules on competition to avoid unfair commercial practices.

In view of its practical importance, he recommended that the secretariat continue its research on the subject in order to prepare model legislation to serve as guidelines for developing countries that wished to promote ship leasing and to promote awareness as to the operation and functioning of ship leasing and its potential advantages for developing countries.
