Thus, the Convention on Biological Diversity, adopted in 1992, stipulates, in its article 8, that regulatory provisions relating to the knowledge, innovations and practices of indigenous communities embodying traditional lifestyles are of importance for the conservation and sustainable use of biological diversity.
وتنص الاتفاقية المتعلقة بالتنوع البيولوجي المعتمدة في عام 1992 في المادة 8 منها على أن المعايير الخاصة بالمعارف والابتكارات وممارسات المجتمعات الأصلية التي تجسد أساليب الحياة التقليدية هي هامة من أجل الحفاظ على التنوع البيولوجي ومن أجل الانتفاع به على نحو مستدام.

The Secretariat of the Convention on Biological Diversity indicates that future meetings of the organs of the Convention are likely to dedicate considerable effort over the medium term to consideration of those provisions of the Convention that concern indigenous and local communities embodying traditional lifestyles.
وتشير أمانة اتفاقية التنوع البيولوجي إلى أن من المرجح أن تكرس الاجتماعات التي تعقدها أجهزة الاتفاقية في المستقبل جهدا كبيرا في اﻷجل المتوسط ﻷجل النظر في أحكام الاتفاقية المعنية بالسكان اﻷصليين والمجتمعات المحلية التي تجسد أساليب الحياة التقليدية.

The Convention Secretariat draws attention to the fact that the Convention is the first legally binding international agreement to provide for the equitable sharing of the benefits arising from the utilization of the knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles.
وتوجه أمانة لجنة التنمية المستدامة الانتباه إلى أن الاتفاقية هي أول اتفاق دولي ملزم قانونا ينص على التقاسم المنصف للفوائد الناجمة عن معارف وابتكارات وممارسات المجتمعات اﻷصلية والمحلية التي تجسد أساليب الحياة التقليدية.

1. Article 8 (j) of the Convention on Biological Diversity calls upon State parties to respect, preserve and maintain knowledge, innovations and practices of indigenous and local communities that embody traditional lifestyles relevant for the conservation and sustainable use of biological diversity.
1- تطلب المادة 8 (ي) من الاتفاقية المتعلقة بالتنوع البيولوجي إلى الدول الأطراف احترام وحفظ وصون معارف وابتكارات وممارسات المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي واستخدامه على نحو قابل للاستمرار.

Considering that a majority of Governments have recognized the need to respect, preserve and maintain the knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles relevant for the conservation of biological diversity, as described in article 8 (j) of the Convention on Biological Diversity,
وإذ تضع في اعتبارها أن غالبية من الحكومات قد اعترفت بالحاجة إلى احترام وصون وحفظ معارف وابتكارات وممارسات مجتمعات السكان اﻷصليين والمجتمعات المحلية التي تجسد أساليب الحياة التقليدية المناسبة لحفظ التنوع البيولوجي كما ورد وصفها في المادة ٨)ي( من اتفاقية التنوع البيولوجي،

16. The Convention established, early on, a process to ensure that knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles relevant for the conservation and sustainable use of biological diversity were considered in all relevant sectoral and thematic areas in the implementation of the Convention.
١٦ - وقد وضعت الاتفاقية، في وقت مبكر، عملية تكفل مراعاة لمعارف وابتكارات وممارسات المجتمعات اﻷصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي واستخدامه على نحوٍ قابلٍ للاستمرار في جميع المجالات القطاعية والمواضيعية ذات الصلة عند تنفيذ الاتفاقية.

It is stated in article 8 (j), inter alia, that States shall, as far as possible and as appropriate, respect, preserve and maintain knowledge, innovations and practices of indigenous communities embodying traditional lifestyles relevant for the conservation and sustainable use of biological diversity.
وكان من بين ما تضمنتــه المــادة ٨ )ي( أن تقوم الدول، قدر اﻹمكان وحسب الاقتضاء، باحترام وصون المعارف والابتكارات وممارسات المجتمعات اﻷصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي واستخدامه على نحو قابل للاستمرار.

Article 8 (j) addresses the knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles relevant for the conservation and sustainable use of biological diversity.
وتتناول المادة 8 (ي) من هذه الاتفاقية قضايا معارف وابتكارات وممارسات المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بالمحافظة على التنوع البيولوجي واستخدامه المستدام.

(a) Application and development of legal and other forms of protection for the knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles relevant to the conservation and sustainable use of forest biological diversity;
)أ( تطبيق واستحداث الحماية القانونية وغيرها من أشكال الحماية لمعارف وابتكارات وممارسات المجتمعات اﻷصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي للغابات واستخدامه على نحوٍ قابل للاستمرار؛

Indigenous and local communities embodying traditional lifestyles relevant for the conservation and sustainable use of biodiversity are seen as important actors in the implementation of the CBD and many indigenous groups are represented at the meetings of the Convention as observers or are included in national delegations.
وتعتبر المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بحفظ التنوع البيولوجي واستخدامه على نحو قابل للاستمرار جهات فاعلة مهمة في تنفيذ الاتفاقية المتعلقة بالتنوع البيولوجي، ويتم تمثيل الكثير من جماعات السكان الأصليين في اجتماعات الاتفاقية بصفة مراقب أو يتم ضمها إلى الوفود الوطنية.

II. The Characteristics of traditional knowledge and its role in the global economy For the purposes of this paper and Meeting, the term " traditional knowledge " will be used to refer to " the knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles " as well as " indigenous and traditional technologies " (CBD Art. 8(j) and 18.4).
9- لأغراض هذه الورقة وأغراض الاجتماع، يقصد بمصطلح " المعارف التقليدية " " معارف المجتمعات الأصلية والمحلية وابتكاراتها وممارساتها التي تجسد أساليب الحياة التقليدية " بالإضافة إلى " التكنولوجيات المحلية والتقليدية " (اتفاقية التنوع البيولوجي، المادة 8(ي) والمادة 8(ي)-4)(1).

Contracting parties to the Convention are requested in article 8 (j) to respect, preserve and maintain knowledge, innovations and practices of indigenous and local communities embodying traditional lifestyles relevant for the conservation and sustainable use of biological diversity.
ويطلب في المادة 8(ي) من الاتفاقية أن تحترم الأطراف المتعاقدة المعارف والابتكارات وممارسات المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي واستخدامه على نحو قابل للاستمرار.

(e) Decision IV/9, in which the Conference invited the World Intellectual Property Organization to take into account the lifestyles and the traditional systems of access and use of the knowledge, technologies and practices of indigenous and local communities embodying traditional lifestyles.
)ﻫ( المقرر ٤/٩، الذي دعا فيه المؤتمر المنظمة العالمية للملكية الفكرية إلى أن تأخذ في الحسبان أساليب الحياة والنظم التقليدية للوصول إلى المعارف والتكنولوجيات وممارسات المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية واستخدام تلك المعارف والتكنولوجيات والممارسات.

In particular, article 8 (j) and related provisions directly address matters of the utmost importance to indigenous and local communities by focusing on the respect, preservation and maintenance of the knowledge, innovations and practices of indigenous and local communities, embodying traditional lifestyles relevant for the conservation and sustainable use of biological diversity.
فالمادة 8 (ي) والأحكام المتصلة بها، بوجه خاص، تتناول مسائل بالغة الأهمية لمجتمعات الشعوب الأصلية والمجتمعات المحلية إذ تركز على احترام وحفظ وصون معارف وابتكارات وممارسات هذه المجتمعات، التي تجسد أساليب الحياة التقليدية ذات الصلة بحفظ التنوع البيولوجي واستخدامه المستدام.

Furthermore, the contracting parties invited case studies and information on " matters of prior informed consent, fair and equitable sharing of benefits and in situ conservation in lands and territories used by indigenous and local communities embodying traditional lifestyles relevant to the conservation and sustainable use of biological diversity. "
وفضلاً عن ذلك دعت الأطراف المتعاقدة إلى إجراء دراسات حالة ومعلومات عن " مسائل الموافقة المسبقة عن علم والاقتسام المنصف والعادل للموارد والحفظ في داخل الوضع الطبيعي في الأراضي والأقاليم المستخدمة من المجتمعات المحلية والأصلية التي تجسد أساليب الحياة التقليدية ذات الأهمية لحفظ التنوع البيولوجي واستخدامه المستدام " .

فالمادة 8 (ي) تدعو الأطراف إلى القيام باحترام المعارف والابتكارات وممارسات المجتمعات الأصلية والمحلية التي تجسد أساليب الحياة التقليدية ذات الصلة بصيانة التنوع البيولوجي واستخدامه على نحو قابل للاستمرار، والحفاظ عليها وصونها.
