وذكر أن الفقرتين الفرعيتين ستنصان على أنه يمكن تحديد فترة زمنية يتعين على المدين خلالها أن يتعاون مع ممثل الإعسار، وعندما تكون تلك الفترة قد انقضت يصبح إبراء الذمة نافذا، شريطة أن يكون المدين قد تعاون ولم يتصرف على نحو تدليسي.

It was agreed that the reference to acting fraudulently should be retained and possibly combined with a more objective formulation along the lines of " has performed its obligations under the insolvency law " .
واتفق على ضرورة الابقاء على الاشارة إلى التصرف على نحو تدليسي وامكانية دمجها مع صيغة أكثر موضوعية على غرار الصيغة التالية: " أوفى بالتزاماته بموجب قانون الاعسار " .

(b) The debtor may be discharged completely and immediately where the debtor has not acted fraudulently and has cooperated with the insolvency representative in performing its obligations under the insolvency law;

" ٢ - إذا حملت الدولة على القيام بفعل نتيجة لسلوك تدليسي لدولة أخرى؛

135. Moreover, as in the 1969 Convention, a State may invoke the invalidity of an act if it has been induced to formulate the act by the fraudulent conduct of another State.
١٣٥ - وعلاوة على ذلك، وكما يرد في اتفاقية عام ١٩٦٩، يجـوز للدولـة أن تتمسـك ببطـلان الفعــل إذا ما حُملت على القيام بالفعل نتيجة لسلوك تدليسي لدولة أخرى.

A State [or States] that formulate[s] a unilateral act may invoke fraud as a defect in the expression of will if it has/they have been induced to formulate an act by the fraudulent conduct of another State.
يجوز للدولة [أو الدول] التي تصدر عملا انفراديا أن تستظهر بالتدليس عيبا في التعبير عن الإرادة إذا حُملت على إصدار عمل بسلوك تدليسي لدولة أخرى.

46. With regard to unilateral acts, the proposal submitted to the Commission in the second report appears in paragraph 2 of what was then draft article 7, according to which, " If a State has been induced to formulate an act by the fraudulent conduct of another State " , it may invoke the invalidity of the act.
