Concerning the decision to expel the complainant, the Court of Appeal reasoned as follows:
وفيما يتعلق بقرار ترحيل صاحب الشكوى، عللت محكمة الاستئناف قرارها على النحو التالي:

The Committee asked the State party not to expel the complainant.
تطلب اللجنة إلى الدولة الطرف عدم ترحيل صاحب الشكوى.

It also reiterates that the deportation of the author would not result in irreparable harm, as the author failed to present a prima facie case.
كما تؤكد مجدداً أن ترحيل صاحب البلاغ لن يترتب عليه ضرر لا يمكن جبره، نظراً لأن صاحب البلاغ لم يقدم دعوى ظاهرة الوجاهة.

However, it informed the Committee that it intended to remove the complainant to Iran on 26 March 2006.

8. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, therefore concludes that the return of the complainant to Togo would constitute a breach of article 3 of the Convention.
8- وإن لجنة مناهضة التعذيب، إذ تعمل بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ترى أن ترحيل صاحب الشكوى إلى توغو سيشكل انتهاكاً للمادة 3 من الاتفاقية.

The Committee observes that in order to be re-deported to the Republic of Moldova under the provisions of article 24 of Romania Law No. 302/2004, there must be an extradition request from the Republic of Moldova that the author is wanted for criminal proceedings.
وتلاحظ اللجنة أنه من أجل إعادة ترحيل صاحب البلاغ إلى جمهورية مولدوفا بموجب المادة 24 من قانون رومانيا رقم 302/2004، يلزم وجود طلب من جمهورية مولدوفا لتسليم صاحب البلاغ لأغراض الملاحقة الجنائية.

10.6 As to the risk of torture at the time the complainant was removed, the Committee must determine whether, in sending the complainant back to India, the State party failed to meet its obligation under article 3 of the Convention not to expel or return anyone to another State where there are substantial reasons for believing that they would be in danger of being subjected to torture.
10-6 وفيما يتعلق بوجود خطر التعرض للتعذيب وقت إبعاد صاحب الشكوى، على اللجنة أن تبت في ما إذا كان ترحيل صاحب الشكوى إلى الهند يشكل خرقاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية بعدم طرد أي شخص أو إعادته إلى دولة أخرى إذا توافرت لديها أسباب حقيقية تدعو إلى الاعتقاد بأنه سيتعرض لخطر التعذيب.

6.6 After the complainant had been deported, the two applications for leave and judicial review of the 11 May 2006 protection decision and of the removal order were granted.
6-6 وبعد ترحيل صاحب الشكوى، قُبل كل من طلب الإذن وطلب المراجعة القضائية لقرار الحماية المؤرخ 11 أيار/مايو 2006 وقرار تنفيذ ترحيل صاحب الشكوى.

7.2 The issue before the Committee is whether the expulsion of the complainant to Togo would constitute a violation of the State party's obligation under article 3 of the Convention not to expel or to return a person to another State where there are substantial grounds for believing that he would be in danger of being subjected to torture.
7-2 وعلى اللجنة أن تقرر ما إذا كان ترحيل صاحب الشكوى إلى توغو يشكل انتهاكاً لالتزام الدولة الطرف بموجب المادة 3 من الاتفاقية التي تنص على عدم جواز طرد أي شخص أو إعادته إلى دولة أخرى إذا توافرت لدى اللجنة أسباب حقيقية تدعو إلى الاعتقاد بأنه قد يتعرض لخطر التعذيب.

The Committee noted that the State party had not contested the speed with which the author was deported, after the decision of the Superior Court and, therefore, irrespective of whether the author could have appealed his case on the merits, found that it would be unreasonable to expect the author to appeal such a case after his deportation, the very act which was claimed to violate the Covenant.
وتلاحظ اللجنة أن الدولة الطرف لم تعترض على سرعة ترحيل صاحب البلاغ بعد صدور قرار المحكمة العليا ضده وبالتالي، وبصرف النظر عما إذا كان بمقدوره الاستئناف، ترى اللجنة أن من غير المعقول توقع أن يتمكن صاحب البلاغ من استئناف مثل هذه القضية بعد أن تم إبعاده، وهو التصرف الذي اعتُبِر انتهاكا للعهد.
