38. Mr. Chernichenko said that no rules or recommendations could change the situation of languages that were in the process of disappearing.
٨٣- وقال السيد تشرنيتشنكو أنه لا يمكن ﻷي قواعد أو توصيات أن تغيّر وضع اللغات التي هي في طريقها إلى الزوال.

Mr. Chernichenko said that his working paper contained merely a working hypothesis which he did not expect the Working Group to adopt but which should serve as a guideline for the further elaboration of a working definition of minorities.
وقال السيد تشرنيتشنكو إن ورقة عمله تتضمن مجرد فرضية عمل لا يتوقع من الفريق العامل أن يعتمدها وإنما ينبغي أن تكون بمثابة مبدأ توجيهي ﻹعداد تعريف عملي مفصل لﻷقليات.

375. In accordance with rule 48 of the rules of procedure of the functional commissions of the Economic and Social Council, Mr. Chernichenko moved for the adjournment of the meeting.
٥٧٣- ووفقاً للمادة ٨٤ من النظام الداخلي للجان الفنية للمجلس الاقتصادي والاجتماعي، اقترح السيد تشرنيتشنكو رفع الجلسة.

44. Mr. Chernichenko stated that the interrelationship between assimilation and integration was a key factor in the acquisition and maintenance of cultural identity.
٤٤- وذكر السيد تشرنيتشنكو أن العلاقة بين الذوبان والاندماج هي عامل أساسي في اكتساب الهوية الثقافة والحافظ عليها.

Mr. Chernichenko stated that his working paper contained merely a working hypothesis which he did not expect the Working Group to adopt but which should act as a guideline to be further elaborated and refined.
وذكر السيد تشرنيتشنكو أن ورقة العمل التي يقدمها لا تحوي سوى افتراض جدلي عملي لا يتوقع أن يعتمده الفريق العامل، ولكن يمكن الاسترشاد به والسعي الى زيادة تفصيله وصقله.

As to the comment made by the observer for Finland, Mr. Chernichenko reiterated that during the elaboration of the Declaration by the Working Group, it was agreed that it did not apply to indigenous people.
وبصدد تعليق مراقب فنلندا، كرر السيد تشرنيتشنكو القول بأنه عند إعداد الفريق العامل لﻹعلان، اتُفق على أنه لن يسري على الشعوب اﻷصلية.

Mr. Chernichenko disagreed with the comment made by the observer for Azerbaijan, as national minorities could in certain cases, especially if they were living compactly on a territory, be a minority today and become a people tomorrow.
كما أبدى السيد تشرنيتشنكو عدم موافقته على تعقيب مراقب أذربيجان ﻷن اﻷقليات القومية يمكن في بعض الحالات، وخاصة إذا كانت تعيش متجاورة بصورة مكثفة في رقعة من اﻷرض، أن تكون أقلية اليوم وتصبح شعباً غداً.

The question remained as to how this could be realized and, in that respect, Mr. Chernichenko agreed that some clarifications to the working paper were needed; he would prepare a new version for the next session reflecting the comments and suggestions made.
والسؤال هنا هو كيف يمكن تحقيق ذلك؟ وفي هذا الصدد، وافق السيد تشرنيتشنكو على وجوب إدراج بعض الايضاحات في ورقة العمل؛ ووعد بإعداد صيغة جديدة للدورة القادمة تراعى فيها التعليقات والاقتراحات التي أبديت.

103. Mr. Ali Khan congratulated Mr. Chernichenko on his attempt to arrive at a working definition and reiterated the usefulness of determining the characteristics common to persons belonging to minorities.
١٠٣- وهنأ السيد على خان السيد تشرنيتشنكو على محاولته للتوصل إلى تعريف عملي وكرر ذكر فائدة تحديد الخصائص المشتركة بين اﻷشخاص المنتمين إلى أقليات.

104. Mr. Chernichenko reiterated that, rather than a strict legal definition, he had attempted to provide a working definition which would help in identifying the groups which were to benefit from the protection of minority-related rights contained in international human rights instruments.
١٠٤- وكرر السيد تشرنيتشنكو القول بأنه حاول، بدلا من وضع تعريف قانوني صارم، تقديم تعريف عملي يساعد على تعيين الجماعات التي يجب أن تستفيد من حماية الحقوق ذات الصلة باﻷقليات المنصوص عليها في الصكوك الدولية المتعلقة بحقوق اﻹنسان.

With reference to the exclusion of indigenous peoples provided for in article 6, Mr. Chernichenko recalled article 8 of the definition annexed to his working paper, which covered situations in which indigenous peoples could in certain circumstances be considered as minorities.
وفيما يتعلق باستبعاد السكان اﻷصليين المنصوص عليه في المادة ٦ ، أشار السيد تشرنيتشنكو إلى المادة ٨ من التعريف المرفق بورقة عمله، والذي يغطي حالات يمكن في ظروف معينة أن يعتبر فيها السكان اﻷصليون أقليات.

٤٧٣- وأدلى ببيان في هذا الصدد كل من السيد ألفونسو مارتينِس والسيد تشرنيتشنكو والسيد جوانيه والسيدة غوانميزيا والسيدة ورزازي.

47. With reference to the right of choice of minorities to integrate or assimilate, Mr. Chernichenko felt that assimilation in itself was negative but that forced assimilation amounted to serious discrimination.
٧٤- وفيما يتعلق بحق اﻷقليات في الاختيار بين الاندماج أو الذوبان، رأى السيد تشرنيتشنكو أن الاستيعاب أو الذوبان في حد ذاته أمر سلبي أما اﻹذابة باﻹكراه فهي شكل خطير من أشكال التمييز.

131. Mr. Chernichenko presented his paper (E/CN.4/Sub.2/AC.5/1996/WP.1) on the definition of minorities and highlighted a number of issues which he deemed particularly important.
١٣١- عرض السيد تشرنيتشنكو ورقته )E/CN.4/Sub.2/AC.5/1996/WP.1( عن تعريف اﻷقليات. وسلط اﻷضواء على عدد من القضايا التي رأى أن لها أهمية خاصة.

132. Mr. Chernichenko noted that in the light of the understanding reached by the Working Group entrusted with the elaboration of the Declaration, the right of peoples to self-determination did not extend to minorities.
٢٣١- ولاحظ السيد تشرنيتشنكو أنه في ضوء التفاهم الذي تم الوصول إليه في الفريق العامل المكلف بإعداد اﻹعلان، فإن حق الشعوب في تقرير مصير لا يمتد إلى اﻷقليات.

134. The observers for Nigeria and the Republic of Korea and Professor Hannum agreed with Mr. Chernichenko that it was necessary to identify common elements of a definition which could serve as a basis for the work of the Working Group.
٤٣١- ووافق مراقبا نيجيريا وجمهورية كوريا والبروفسور هانوم مع السيد تشرنيتشنكو على أن من الضروري تحديد عناصر مشتركة لتعريف يمكن أن يتخذهما الفريق العامل أساساً لعمله.

136. Mr. Khalil said that the lack of a clear definition of minorities should not constitute an obstacle to the work of the Working Group. An exchange of views on the issue could be encouraged to facilitate the Working Group's task as suggested by Mr. Chernichenko.
٦٣١- وقال السيد خليل إن الافتقار الى تعريف واضح لﻷقليات لا يصح أن يشكل عقبة لعمل الفريق العامل، وأنه يصح تشجيع تبادل اﻵراء حول القضية لتيسير مهمة الفريق العامل على النحو الذي اقترحه السيد تشرنيتشنكو.

140. The observer for Switzerland mentioned that there already existed sufficient elements which allowed for the recognition of a minority in so far as an " expression of coverage " was concerned. The observer agreed with Mr. Chernichenko on the need to elaborate guidelines on the notion of minorities.
٠٤١- وذكر مراقب سويسرا أنه توجد بالفعل عناصر كافية تسمح بالاعتراف بأقلية ما من حيث " التعبير عن الانطباق " ، ولكنه وافق مع السيد تشرنيتشنكو على الحاجة الى تطوير مبادئ ارشادية بشأن مفهوم اﻷقليات.

144. The observers for the Legal Information Centre for Human Rights referred to article 1 of Mr. Chernichenko's paper and the danger of including in a definition of minority only those persons who were permanently resident in the territory of a State.
٤٤١- وأشار مراقب مركز اﻹعلام القانوني لحقوق اﻹنسان الى المادة ١ من ورقة السيد تشرنيتشنكو والخطر المترتب على قصر تعريف اﻷقلية على اﻷشخاص الذين يقيمون اقامة دائمة في اقليم الدولة.
