وفي غياب أية تفسير من الدولة الطرف بشأن طابع التحقيق الذي يُزعم أن سلطاتها قد أجرته، وفي ضوء المضايقات التي تعرض لها صاحب البلاغ نتيجة استفساراته عن مصير والده ومكان وجوده، فإنه يشكك في أن التحقيق المزعوم قد أُجري بالفعل واستوفى الشروط المطلوبة بمقتضى القانون الدولي.

وفي هذا الصدد، تحيط اللجنة علماً بالوصف التفصيلي للمعاملة التي تعرض لها صاحب الشكوى أثناء الاحتجاز لدى الشرطة، وبمحتوى تقرير الطب الشرعي رقم 3393 المؤرخ 10 كانون الأول/ديسمبر 2008، الذي يوثق الإصابات البدنية التي ألحقت بصاحب الشكوى بغرض إجباره على الاعتراف بالذنب في جرائم القتل المتعددة والسرقة والجرائم الأخرى.
