Among the major contributions of the draft articles were the reaffirmation of diplomatic protection as a right of the State, the maintenance of nationality as the basic criterion for the exercise of diplomatic protection, and the definition of continuity of nationality as the period extending from the date of injury to the date of official presentation of the claim.

In all the circumstances it seems appropriate to require that a State which exercises diplomatic protection on behalf of a corporation must prove that the corporation was a national under its laws both at the time of injury and at the date of the official presentation of the claim.
98 - في جميع الأحوال يبدو من الملائم أن يُطلب إلى الدولة التي تمارس الحماية الدبلوماسية لصالح شركة ما أن عليها أن تثبت أن الشركة كانت من رعاياها وفقا لقوانينها في وقت حدوث الضرر وفي وقت تقديم المطالبة رسميا.

The Commission had also adopted the correct approach when it had laid down the principle of the continuous nationality of a natural person or corporation between the date of the injury and the date of the official presentation of the claim (draft articles 5 and 10).
