- تكفل كل دولة طرف أن تجرِّم بموجب قانونها الوطني جميع أنشطة الشركات العسكرية والأمنية الخاصة التي تتم من دون التراخيص والأذون المطلوبة، بما فيها تصدير واستيراد الخدمات العسكرية والأمنية.

2. each State Party shall ensure that the necessary measures are nationally coordinated, in both planning and implementation.
2- تكفل كل دولة طرف أن تكون التدابير اللازمة منسقة وطنياً،() من حيث تخطيطها وتنفيذها على السواء.

3. each State Party shall ensure that any contract or agreement between the State party and a PMSC on provision of military and/or security services entered into by a PMSC and its employees is in accordance with international law and is consistent with the legislation of:
3- تكفل كل دولة طرف أن يكون أي عقد أو اتفاق بين الدولة الطرف وشركة عسكرية و/أو أمنية خاصة بشأن توفير تلك الشركة وموظفيها لخدمات عسكرية و/أو أمنية متسقا مع القانون الدولي ومع تشريعات:

2. each State Party shall ensure that all licences and authorizations issued to PMSCs and their personnel shall be registered in the general Registry of the State and shall be granted following a transparent and open procedure.
2- تكفل كل دولة طرف أن تُسجَّل جميع الرخص والتصاريح الصادرة للشركات العسكرية والأمنية الخاصة وموظفيها في السجل العام للدولة وأن تُمنح بناء على إجراءات شفافة ومفتوحة.

1. each State Party shall ensure that the acts of carrying out inherently State functions, as specified in article 9 of this Convention by PMSCs and their personnel are offences under its national law.
1- تكفل كل دولة طرف أن يتضمن قانونها الوطني حكما بتجريم اضطلاع الشركات العسكرية والأمنية الخاصة وموظفيها بوظائف هي بطبيعتها وظائف منوطة بالدولة، على النحو المحدد في المادة 9 من هذه الاتفاقية.

- each State Party shall ensure that personnel of PMSCs are professionally trained to respect relevant international human rights law and international humanitarian law.
- تكفل كل دولة طرف أن يكون موظفو الشركات العسكرية والأمنية الخاصة مدرَّبين تدريباً مهنياً على احترام القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي ذوي الصلة.

- each State Party shall ensure that PMSC personnel are professionally trained and vetted according to the applicable international standards, in particular regarding the use of specific equipment and firearms.
- تكفل كل دولة طرف أن يكون موظفو الشركات العسكرية والأمنية الخاصة مدرَّبين تدريباً مهنياً ومجازين وفقاً للمعايير الدولية السارية، ولا سيما فيما يتعلق باستخدام معدات وأسلحة نارية بعينها.

3. each State Party shall ensure that any contract or agreement between the State party and a PMSC on provision of military and/or security services entered into by a PMSC and its employees is in accordance with international law and is consistent with the legislation of:
3- تكفل كل دولة طرف أن يكون أي عقد أو اتفاق بين الدولة الطرف وشركة عسكرية و/أو أمنية خاصة بشأن توفير تلك الشركة وموظفيها لخدمات عسكرية و/أو أمنية متسقاً مع القانون الدولي ومع تشريعات:

2. each State Party shall ensure that PMSCs and their personnel apply due diligence to ensure that their activities do not contribute directly or indirectly to violations of human rights and international humanitarian law.
2- تكفل كل دولة طرف أن تبذل الشركات العسكرية والأمنية الخاصة وموظفوها العناية الواجبة لكي لا تسهم أنشطتهم بشكل مباشر أو غير مباشر في انتهاك القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي.

1- تكفل كل دولة طرف أن يراعي قانونها الداخلي ضرورة مكافحة الفساد، وأن ينص خصوصا على سبل انتصاف فعالة للأشخاص الذين تتأثر حقوقهم ومصالحهم بالفساد، بغية تمكينهم من الحصول، وفقا لمبادئ قانونها الداخلي، على تعويضات عن الأضرار.

1. each State Party shall ensure that, as a minimum, the following acts and activities are fully covered under its criminal or penal law, whether these offences are committed domestically or transnationally or on an individual or organized basis:
1 - تكفل كل دولة طرف أن تغطي، كحد أدنى، الأفعال والأنشطة التالية تغطية كاملة بموجب قانونها الجنائي أو قانون العقوبات فيها سواء أكانت هذه الجرائم ترتكب محلياً أو دولياً أو كانت ترتكب على أساس فردي أو منظم:

4- تكفل كل دولة طرف أن يتقيد موظفو الشركات العسكرية والأمنية الخاصة تقيداً صارماً بالمعايير ذات الصلة من القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي، متبعة سيلاً منها إجراء تحقيق فوري مع مرتكبي انتهاكات القانون الدولي لحقوق الإنسان والقانون الإنساني الدولي ومقاضاتهم ومعاقبتهم.
