A unilateral statement made by a State or an international organization when that State or organization expresses its consent to be bound by a treaty, in accordance with a clause expressly authorizing the parties or some of them to exclude or to modify the legal effect of certain provisions of the treaty in their application to those parties, constitutes a reservation.
يشكل تحفظاً الإعلان الانفرادي الذي تصدره دولة أو منظمة دولية عند إعراب تلك الدولة أو المنظمة عن موافقتها على الالتزام بمعاهدة، وفقاً لشرط صريح يرخص للأطراف أو لبعضها استبعاد أو تعديل الأثر القانوني لأحكام معينة من المعاهدة من حيث انطباقها على هذه الأطراف.

2. For each State or regional economic integration organization ratifying, accepting, approving or acceding to this Convention after the deposit of the fortieth instrument of such action, this Convention shall enter into force on the thirtieth day after the date of deposit by such State or organization of the relevant instrument.
2- يبدأ نفاذ هذه الاتفاقية، بالنسبة لكل دولة أو منظمة اقليمية للتكامل الاقتصادي تصدق على هذه الاتفاقية أو تقبلها أو تقرها أو تنضم اليها بعد ايداع الصك الأربعين من تلك الصكوك، في اليوم الثلاثين من تاريخ ايداع تلك الدولة أو المنظمة ذلك الصك ذا الصلة.

" Objection " means a unilateral statement, however phrased or named, made by a State or an international organization in response to a reservation formulated by another State or international organization, whereby the former State or organization purports to preclude the reservation from having its intended effects or otherwise opposes the reservation.
يقصد بتعبير " الاعتراض " أي إعلان انفرادي، أيا كانت صيغته أو تسميته، تصدره دولة أو منظمة دولية، ردا على تحفظ على معاهدة صاغته دولة أخرى أو منظمة دولية أخرى، وتهدف به تلك الدولة أو المنظمة إلى منع الآثار المتوخاة من التحفظ، أو معارضة التحفظ على نحو آخر.

Such non-maintenance became operative in relation to a contracting State or organization only when notice of it had been received by that State or that organization.
ولا يكون عدم إبقاء الدولة الخَلَف على القبول الصريح الذي صاغته الدولة السَلَف بشأن تحفظ صاغته دولة أو منظمة متعاقدة نافذا إلا عندما تتسلم تلك الدولة أو المنظمة إشعارا به.

2- بالنسبة لكل دولة أو منظمة إقليمية للتكامل الاقتصادي تصدق على هذه الاتفاقية أو تقبلها أو تقرها أو تنضم إليها، بعد إيداع الصك [العشرين] [الأربعين] المتعلق بذلك الإجراء، يبدأ نفاذ هذه الاتفاقية في اليوم الثلاثين من تاريخ إيداع تلك الدولة أو المنظمة الصك ذا الصلة.

يقصد بتعبير " الاعتراض " أي إعلان انفرادي، أياً كانت صيغته أو تسميته، تصدره دولة أو منظمة دولية، رداً على تحفظ على معاهدة صاغته دولة أخرى أو منظمة دولية أخرى، وتهدف به تلك الدولة أو المنظمة إلى منع الآثار المتوخاة من التحفظ، أو معارضة التحفظ على نحو آخر.

An objection formulated prior to the expression of consent to be bound by the treaty does not need to be formally confirmed by the objecting State or international organization at the time it expresses its consent to be bound if that State or that organization was a signatory to the treaty when it formulated the objection; it must be confirmed if the State or international organization had not signed the treaty.
لا يتطلب الاعتراض الذي يصاغ قبل الإعراب عن الموافقة على الالتزام بالمعاهدة تأكيدا رسميا من الدولة أو المنظمة الدولية المعترضة عند إعرابها عن الموافقة على الالتزام إذا كانت تلك الدولة أو المنظمة من الدول أو المنظمات الموقعة على المعاهدة عند صوغ الاعتراض؛ ويجب تأكيده إذا لم تكن الدولة أو المنظمة قد وقعت على المعاهدة.

(b) that State or international organization commits the act in question in reliance on that authorization or recommendation.
(ب) واستندت تلك الدولة أو المنظمة الدولية إلى هذا الإذن أو هذه التوصية لارتكاب الفعل المعني.

Consent Valid consent by a State or an international organization to the commission of a given act by another international organization precludes the wrongfulness of that act in relation to that State or the former organization to the extent that the act remains within the limits of that consent.
يؤدي القبول الصحيح لدولة أو منظمة دولية لارتكاب منظمة دولية أخرى لفعل معين إلى انتفاء عدم مشروعية ذلك الفعل إزاء تلك الدولة أو المنظمة القابلة بذلك ما دام ذلك الفعل في حدود ذلك القبول.

When a State or international organization making an objection to a reservation intends to preclude the entry into force of the treaty as between itself and the reserving State or international organization, it shall definitely express its intention before the treaty would otherwise enter into force between them.
إذا كانت لدى الدولة أو المنظمة الدولية المعترضة على تحفظ ما نية منع دخول المعاهدة حيز التنفيذ بينها وبين الدولة أو المنظمة الدولية المتحفظة، عليها أن تعرب بوضوح عن تلك النية قبل دخول المعاهدة حيز التنفيذ بينها وبين تلك الدولة أو المنظمة المتحفظة.

Any State or any international organization that was entitled to become a party to the treaty and that had been notified of the reservations could also formulate objections that would produce effects only when the State or organization became a party to the treaty.
فأية دولة أو منظمة دولية مؤهلةٍ لأن تصبح طرفاً في المعاهدة وأُبلغت بالتحفظات يجوز لها أيضاً إبداء اعتراضات لا تترتب عليها آثار إلا عندما تصبح تلك الدولة أو المنظمة طرفاً في المعاهدة.
