13. If extradition, sought for purposes of enforcing a sentence, is refused because the person sought is a national of the requested State Party, the requested State Party shall, if its domestic law so permits and in conformity with the requirements of such law, upon application of the requesting State Party, consider the enforcement of the sentence imposed under the domestic law of the requesting State Party or the remainder thereof.
13- إذا رُفض طلب تسليم مقدَّم لغرض تنفيذ حكم قضائي بحجة أن الشخص المطلوب تسليمه هو من مواطني الدولة الطرف متلقية الطلب، وجب على الدولة الطرف متلقية الطلب، إذا كان قانونها الداخلي يسمح بذلك ووفقا لمقتضيات ذلك القانون، أن تنظر، بناء على طلب من الدولة الطرف الطالبة، في إنفاذ العقوبة المفروضة بمقتضى القانون الداخلي للدولة الطرف الطالبة أو ما تبقى منها.

10. ٠١ - اذا رفض طلب تسليم ، مقدم بغرض تنفيذ حكم قضائي ، بحجة أن الشخص المطلوب تسليمه من مواطني الدولة الطرف متلقية الطلب ، وجب على الطرف متلقي الطلب ، اذا كان قانونه يسمح بذلك واذا كان ذلك يتفق ومقتضيات ذلك القانون ، وبناء على طلب من الطرف الطالب ، أن ينظر في تنفيذ الحكم الصادر بمقتضى قانون الطرف الطالب ، أو ما تبقى من العقوبة المحكوم بها .

The Committee's reference to subparagraph (c), however, is misleading as it was not the failure to enforce a judicial remedy but the failure to provide for an effective remedy in the first place which led to a violation of article 2.
بيد أن إشارة اللجنة إلى الفقرة الفرعية (ج) هي إشارة مضللة لأن ما أدى إلى انتهاك المادة 2 ليس عدم تنفيذ حكم قضائي وإنما عدم إتاحة سبيل انتصاف فعال في المقام الأول.
