38. Mr. Orr (Canada) said that his delegation welcomed the report on the investigation into allegations of refugee smuggling at the Nairobi Branch Office of UNHCR (A/56/733). The investigation had entailed a unique and innovative partnership among Member States and the Secretariat, to which Canada had contributed.

40. Mr. Mustafa (Sudan) said that his delegation supported the statement by Morocco on behalf of the Group of African States. He welcomed the effective and decisive measures taken by OIOS following its investigation into allegations of refugee smuggling at the Nairobi Branch Office of UNHCR (A/56/733), and paid tribute to the investigators whose efforts had led to the demise of that criminal network.
40 - السيد مصطفى (السودان): قال إن وفد بلده يؤيد البيان الذي أدلى به المغرب باسم مجموعة الدول الأفريقية، ورحب بالتدابير الفعالة الحاسمة التي اتخذها مكتب خدمات الرقابة الداخلية في أعقاب التحقيقات التي أجراها في مزاعم تهريب اللاجئين في المكتب الفرعي لمفوضية الأمم المتحدة لشؤون اللاجئين في نيروبي (A/56/733)، ونوه بالمحققين الذين أسفرت جهودهم عن القضاء على تلك الشبكة الإجرامية.

States are obliged by virtue of article 18, paragraph 8, and article 19, paragraph 1, to ensure that the implementation of the smuggling of migrants Protocol does not detract from existing protections afforded by international law to migrants who are refugees or asylum-seekers.
16- بموجب الفقرة 8 من المادة 18، والفقرة 1 من المادة 19، فإنَّ الدول ملزمة بأن تضمن أنَّ تنفيذ بروتوكول مكافحة تهريب اللاجئين لا يحول دون الحصول على الحماية التي يكفلها القانون الدولي للمهاجرين اللاجئين أو طالبي اللجوء.

7. Urges States and relevant international organizations to develop national, regional and international strategies and other necessary measures that complement the work of the United Nations Crime Prevention and Criminal Justice Programme in addressing effectively the significant problems posed by the smuggling of migrants and trafficking in persons and related activities;
7 - تحث الدول والمنظمات الدولية المختصة على وضع استراتيجيات وطنية وإقليمية ودولية واتخاذ تدابير ضرورية أخرى تكمل عمل برنامج الأمم المتحدة لمنع الجريمة والعدالة الجنائية في التصدي الفعال للمشاكل الكبيرة التي يشكلها تهريب اللاجئين والاتجار بالأشخاص وما يتصل بذلك من أنشطة؛
