1. Where a certification service provider provides services to support an electronic signature that may be used for legal effect as a signature, that certification service provider shall:

The view was expressed that, in practice, a person could not become a signatory before he or she had actually used the signature creation data to produce an electronic signature.

It was proposed that opening clauses should be added in draft articles 8 and 9 to the effect that they would only apply where the signatory intended to create an electronic signature that complied with draft article 6 or when a certification service provider rendered services intended to support the creation of such an electronic signature.

Having considered various options, the Working Group expressed a preference for formulations that avoided reference to the intention of the signatory to create a legally-recognized electronic signature or to create a signature that produced legal effects.
118- وبعد أن نظر الفريق العامل في مختلف الخيارات، أعرب عن تفضيله الصياغات التي تتجنب الإشارة الى نية الموقّع في انشاء توقيع إلكتروني معترف به قانونا أو في انشاء توقيع تنجم عنه آثار قانونية.

Nothing in this Law, except article 5, shall be applied so as to exclude, restrict or deprive of legal effect any method of creating an electronic signature that satisfies the requirements referred to in article 6, paragraph 1, or otherwise meets the requirements of applicable law.
لا يُطبّق أي من أحكام هذا القانون، باستثناء المادة 5، بما يشكّل استبعادا أو تقييدا أو حرمانا من مفعول قانوني لأي طريقة لإنشاء توقيع إلكتروني تفي بالاشتراطات المشار إليها في الفقرة 1 من المادة 6، أو تفي على أي نحو آخر بمقتضيات القانون المنطبق.

It was generally agreed that, as between themselves and for their own use, parties could agree on the effect of the security procedure they used, including that it was an [enhanced] electronic signature, but that the language of the paragraph needed to clarify that such an agreement could not affect persons who were not party to the agreement.

1. Where the law requires a signature of a person, that requirement is met in relation to a data message if an electronic signature is used that is as reliable as was appropriate for the purpose for which the data message was generated or communicated, in the light of all the circumstances, including any relevant agreement.
1 - حيثما يشترط القانون وجود توقيع من شخص، يُعد ذلك الاشتراط مستوفى بالنسبة إلى رسالة البيانات إذا استُخدم توقيع إلكتروني موثوق به بالقدر المناسب للغرض الذي أُنشئت أو أبلغت من أجله رسالة البيانات، في ضوء كل الظروف، بما في ذلك أي اتفاق ذي صلة.

They recognize that the legal effectiveness of a certificate or electronic signature should depend on its technical reliability.

" حيثما يشترط القانون أن يكون الخطاب أو العقد ممهورا بتوقيع طرف ما، أو ينص على عواقب لعدم وجود توقيع، يستوفى ذلك الشرط فيما يخص الخطاب الإلكتروني إذا استخدم توقيع إلكتروني موثوق من أجل توفير ضمان فيما يتعلق بتعيين محرّر المعلومات الواردة في الخطاب الإلكتروني وبإثبات سلامة تلك المعلومات.

85. It was said that the language in subparagraph (h) could be problematic insofar as the " signature " described was not clearly expressed to be an " electronic signature " in line with other UNCITRAL instruments, and specifically the UNCITRAL Model Law on Electronic Signatures.
85- قيل إنَّ الصياغة المستخدمة في الفقرة الفرعية (ح) قد تكون إشكالية، لأنها لا تُبيِّن بوضوح أنَّ " التوقيع " المذكور هو " توقيع إلكتروني " ، اتِّساقاً مع صكوك الأونسيترال الأخرى، وخصوصاً قانون الأونسيترال النموذجي بشأن التوقيعات الإلكترونية.

That is the purpose of paragraph 3, which is expected to create certainty (through either a presumption or a substantive rule), at or before the time any such technique of electronic signature is used (ex ante), that using a recognised technique will result in legal effects equivalent to those of a handwritten signature.

After deliberation, the Working Group decided that a phrase along the following lines should be added at the beginning of draft article 8: " Where signature creation data can be used to create an electronic signature that has legal effect [...] " .

The Working Group further decided that a phrase such as " Where a certification service provider provides services to support an electronic signature that may be used for legal effect as a signature [...] " should be added at the beginning of draft article 9.
وقرر الفريق العامل كذلك أن تضاف في بداية مشروع المادة 9 عبارة مثل " حيثما يوفر مقدم خدمات تصديق خدمات لدعم توقيع إلكتروني يجوز استخدامه لاعطاء مفعول قانوني بصفته توقيعا [...] " .
