The Jordanian Constitution in its article VIII guarantees the right of every person not to be arrested or imprisoned except in accordance with the provisions of the law.
وقد كفل الدستور الأردني في المادة الثامنة منه حق كل شخص بعدم توقيفه أو حبسه إلا وفق أحكام القانون.

Every person detained, arrested or charged with an offence has the right of access to a lawyer (defence counsel) from the moment he or she is detained, arrested or charged.

وتنص الفقرة ٣ من المادة ٩ من العهد الدولي الخاص بالحقوق المدنية والسياسية على ما يلي: يُقدم أي شخص يتم توقيفه أو احتجازه بتهمة جنائية فورا إلى قاض أو موظف آخر يُخوله القانون بممارسة السلطة القضائية وله الحق في محاكمة ضمن فترة زمنية معقولة أو إطلاق سراحه.

Pursuant to those two Acts, anyone who is arrested or detained shall be informed, at the time of arrest or detention, of the reasons for arrest or detention, and shall also be promptly informed of any charges against him.
وعملاً بهذين القانونين يتوجب إبلاغ أي شخص يتم توقيفه أو احتجازه، وقت توقيفه أو احتجازه، بأسباب ذلك، كما يتوجب إبلاغه سريعاً بأية تهم توجه إليه.

ولا يوجد ما يدل على أن السيد تيتياهونجو أُبلِغ في أي وقت من الأوقات بأسباب توقيفه، أو أنه مثل قط أمام أحد القضاة أو أمام أي موظف قضائي، أو أنه أعطي في أي وقت من الأوقات فرصة الطعن في قانونية توقيفه أو اعتقاله.

4.10 With regard to article 14, the State party notes that the author does not assert that his arrest or imprisonment in relation to importing drugs amounted to a violation of any of the rights guaranteed by the Covenant.
4-10 أما بشأن المادة 14، تلاحظ الدولة الطرف أن صاحب البلاغ لا يجزم بأن توقيفه أو سجنه بسبب استيراد العقاقير المخدرة يمثل انتهاكاً لأي من الحقوق التي يكفلها العهد.

3.2 The author claims a violation of article 9, paragraph 2, as he was arrested without being informed of the reasons for his arrest or the charges against him.
3-2 ويدعي صاحب البلاغ حدوث انتهاك لأحكام الفقرة 2 من المادة 9، باعتبار أنه تم توقيفه دون إفادته بأسباب توقيفه أو بالتهم الموجهة إليه.

The HR Committee concluded that there had been a violation of the right to liberty and security of the person in three cases, including, inter alia, failure to be informed of the grounds of arrest or of any of the charges against the complainant, and unlawful arrest and detention and denial of access to a lawyer.
28- واستنتجت اللجنة المعنية بحقوق الإنسان أن هناك انتهاكاً لحق الفرد في الحرية وفي الأمان على شخصه في ثلاث حالات شملت جملة أمور منها عدم إطلاع صاحب الشكوى على أسباب توقيفه أو على أي من التهم الموجهة إليه والتوقيف والاحتجاز غير القانونيين والمنع من الاتصال بمحام.

Article 18 of the Constitution stated that liberty of the person was guaranteed by the State and that no one could be prosecuted, arrested, detained or convicted except under the conditions specified by the law in force at the time that the act was committed.
