8.7 Regarding the complaint of a violation of article 9, the information before the Committee shows that Djamel and Mourad Chihoub were arrested by agents of the State party without a warrant, then detained incommunicado without access to defence counsel and without being informed of the grounds for their arrest or the charges against them.

Accordingly, the Committee considers that the examination of the cases of Djamel and Mourad Chihoub by the Working Group on Enforced or Involuntary Disappearances does not render the communication inadmissible under this provision.

The Committee concludes, on the basis of the material before it, that the incommunicado detention of Djamel Chihoub and Mourad Chihoub since 1996 and the fact that they were prevented from communicating with their family and the outside world constitute a violation of article 7 of the Covenant in their regard.

3.1 The authors maintain that the facts show that their sons Djamel and Mourad Chihoub were victims of enforced disappearance from the moment they were arrested by agents of the State party on 16 May 1996 and 13 November 1996 respectively.
3-1 يدعي صاحبا البلاغ أن الوقائع تكشف أن ابنيهما جمال ومراد شيهوب تعرضا للاختفاء القسري() منذ اعتقالهما على يد مسؤولي الدولة الطرف في يومي 16 أيار/مايو 1996 و13 تشرين الثاني/نوفمبر 1996 على التوالي.

3.6 Given that Djamel and Mourad Chihoub were not promptly brought before a judge or other judicial authority, the authors maintain that article 9, paragraph 3 was also violated with regard to the victims.
3-6 ويؤكد صاحبا البلاغ أن عدم تقديم جمال ومراد شيهوب سريعاً إلى أحد القضاة أو إلى سلطة قضائية ينطوي أيضاً على انتهاك لحقوقهما بموجب الفقرة 3 من المادة 9().

3.8 The authors also claim that, as victims of enforced disappearance, Djamel and Mourad Chihoub were denied the right to be recognized as having rights and obligations - in other words, were reduced to the status of " non-persons " , in violation of article 16 of the Covenant, by the State party.
3-8 ويدفع صاحبا البلاغ أيضاً بأن تعرض جمال ومراد شيهوب للاختفاء القسري قد حرمهما من الحق في الاعتراف بهما كأصحاب حقوق وواجبات، أي أن صفة الشخص انتفت عنهما، وهو ما ينطوي على انتهاك من جانب الدولة الطرف للمادة 16 من العهد().

Noting that Djamel and Mourad Chihoub were detained incommunicado for 15 years, and were consequently deprived of all contact with their family and the outside world, and pointing out the absence of any information from the State party regarding the treatment they were given during their detention in various military establishments, the Committee finds a violation of article 10, paragraph 1, of the Covenant with regard to the two victims.
وإذ تلاحظ اللجنة احتجاز جمال ومراد شيهوب في مكان غير معروف مدة 15 عاماً، وحرمانهما بالتالي من أي اتصال بعائلتهما وبالعالم الخارجي، وغياب أي معلومات مقدمة من الدولة الطرف بشأن المعاملة التي لقياها أثناء احتجازهما في مؤسسات عسكرية مختلفة، تخلص اللجنة إلى وجود انتهاك للفقرة 1 من المادة 10 من العهد فيما يتعلق بالضحيتين().
