The draft resolution also mentioned the entry into force of the Optional Protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the establishment of the Subcommittee on Prevention of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the adoption in December 2006 of the International Convention for the Protection of All Persons from Enforced Disappearance.
وتمت الإشارة أيضا إلى بدء نفاذ البروتوكول الاختياري لاتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، واعتماد الاتفاقية الدولية لحماية جميع الأشخاص من حالات الاختفاء القسري في كانون الأول/ديسمبر 2006.

28 - واستطرد قائلاً إن بوسع المحقّقين الجنائيين الأكفاء أن يستثيروا دافعية من يمكن أن يكونوا من المُبلغِين بمعلومات كأن يعرضوا مثلاً أحكاماً مخففة على نحو ما تقضي به المادة 4 (2) من إعلان حماية جميع الأشخاص من حالات الاختفاء القسري.

The Working Group reminds all Governments that under article 7 of the Declaration on the Protection of All Persons from Enforced Disappearance ( " Declaration " ), " No circumstances whatsoever, whether a threat of war, a state of war, internal political instability or any other public emergency, may be invoked to justify enforced disappearances " .
ويذكّر الفريق العامل جميع الحكومات بأنه بموجب المادة 7 من الإعلان بشأن حماية جميع الأشخاص من حالات الاختفاء القسري ( " الإعلان " ) " لا يجوز اتخاذ أي ظروف مهما كانت، سواء تعلق الأمر بالتهديد باندلاع حرب أو قيام حالة حرب أو عدم الاستقرار السياسي الداخلي أو أي حالة استثنائية أخرى، ذريعة لتبرير أعمال الاختفاء القسري " .
