It is therefore clear that the restriction on freedom of expression imposed by the Gayssot Act satisfied all the three elements required for the applicability of article 19, paragraph 3, and was not inconsistent with article 19, paragraph 2, and consequently, the conviction of the author under the Gayssot Act was not violative of his freedom of expression guaranteed under article 19, paragraph 2.

30. In the absence of clearly formulated charges concerning specific and legally defined acts and in view of Moussa Kaka's capacity as journalist, the afore-mentioned facts are such as to establish that he has been a victim in respect of the exercise of his freedom of expression.

28. The Working Group on Arbitrary Detention reported on a case of arbitrary arrest and detention in a psychiatric hospital in which an individual was detained allegedly for having exercised his freedom of expression in openly criticizing Government policies (E/CN.4/2006/7/Add.1).

3.3 In all the communications the author claims that his freedom of expression has been restricted arbitrarily in violation of the Constitution and of article 19 of the Covenant, as the restriction in question was neither justified by reasons of national security or public safety, public order, or protection of public health or morals, and was not necessary for the protection of the rights and freedoms of others.
