The Special Rapporteur discusses recent practice and the developments related to the case of the former dictator of Chad, Hissène Habré.
ويناقش المقرر الخاص الممارسة المتبعة مؤخرا والتطورات فيما يتعلق بقضية الدكتاتور التشادي السابق حسين هبري.

70. Ireland welcomed Senegalese efforts to bring Hissène Habré to justice and urged it to ensure his fair and expeditious trial.
70- ورحبت أيرلندا بالجهود التي تبذلها السنغال لتقديم حسين هبري إلى العدالة، وحثتها على ضمان محاكمته بصورة عادلة وسريعة.

It noted with satisfaction the agreement signed by Senegal and the African Union regarding the trial of Hissène Habré.
وأشارت تركيا بارتياح إلى الاتفاق الموقع بين السنغال والاتحاد الأفريقي بشأن محاكمة حسين هبري.

9. According to FIDH/LTDH/ATPDH, 11 Chadian rebel chiefs and the former President, Hissein Habré, were sentenced to death in absentia in August 2008 for endangering the constitutional order and the territory's integrity and security during a summary trial in which the right to defence was not respected.
ووفقاً لهذه المنظمات، فقد حكم غيابياً في آب/أغسطس 2008 على 11 من زعماء المتمردين التشاديين والرئيس السابق حسين هبري بالإعدام، بتهمة الإخلال بالنظام الدستوري وسلامة وأمن الإقليم في محاكمة موجزة لم يحترم فيها أي حق من حقوق الدفاع.

Hissène Habré had been prosecuted in 2013 for crimes committed under his rule, and the Extraordinary African Chambers established within the courts of Senegal were investigating victims' claims.
وكان حسين هبري قد حوكم سنة 2013 عن الجرائم التي ارتكبت في ظل حكمه، وتعكف الدوائر الاستثنائية الأفريقية المنشأة داخل محاكم السنغال على التحقيق في مطالب الضحايا.

However, the best example of the country's desire to respect its international commitments in the fight against impunity was the creation of the Extraordinary African Chambers to try the former Chadian President, Hissène Habré.

114. Switzerland commended Senegal on its commitment against impunity regarding the trial of Hissène Habré.

[found] that the Republic of Senegal must, without further delay, submit the case of Mr. Hissène Habré to its competent authorities for the purpose of prosecution, if it d[id] not extradite him. "

Furthermore, the report refers to the Special Tribunal for Lebanon and the institution of proceedings by Belgium before the International Court of Justice concerning the case of the former President of Chad, Hissène Habré.
وعلاوة على ذلك، يشير التقرير إلى المحكمة الخاصة للبنان وتحريك بلجيكا دعاوى أمام محكمة العدل الدولية بشأن قضية رئيس تشاد السابق، حسين هبري.

The cases of torture which had taken place under the former President, Hissène Habré, would not go unpunished; that would serve as a lesson to any wouldbe perpetrators.

MANDATES the Committee to consider all aspects and implications of the Hissène Habré case as well as the options available for his trial, taking into account the following benchmarks;
3 - يفوض للجنة بحث كافة جوانب وآثار قضية حسين هبري وكذلك الخيارات المتاحة لمحاكمته مع الأخذ في الاعتبار النقاط التالية:

" The National Sovereign Conference, held in N'djaména from 15 January to 7 April 1993, officially waived any immunity from jurisdiction with respect to Mr. Hissène Habré.
" رفع المؤتمر الوطني السيادي المعقود في نجامينا في الفترة من 15 كانون الثاني/يناير إلى 7 نيسان/أبريل 1993 رسميا كل حصانة من الولاية القضائية يتمتع بها السيد حسين هبري.

Several investigatory measures with a view to the punishment of acts of torture, particularly in the proceedings against Mr. Hissène Habré in January 2000;
اتخاذ عدة تدابير تحقيقية بهدف المعاقبة على أفعال التعذيب، لا سيما أثناء محاكمة السيد حسين هبري في كانون الثاني/يناير 2000؛

10. On 15 August, a Chadian court sentenced former President Hissène Habré to death in absentia for allegedly providing " financial, material and moral support " to rebels who attacked the capital in February 2008.
10 - وفي 15 آب/أغسطس، أصدرت محكمة تشادية حكما غيابيا بإعدام الرئيس السابق حسين هبري بدعوى تقديم " الدعم المالي والمادي والمعنوي " للمتمردين الذين هاجموا العاصمة في شباط/فبراير 2008.

Decision on the Hissène Habré Case
مقرر بشأن قضية حسين هبري

On the same day, Belgium filed a request for the indication of provisional measures, asking the Court to require Senegal to take all steps within its power to keep Mr. Hissène Habré under the control and surveillance of the judicial authorities of Senegal so that the rule of international law with which Belgium requested compliance might be correctly applied.
وفي نفس اليوم، قدمت بلجيكا التماسا يتعلق بتدابير تحفظية، وذلك بالطلب إلى المحكمة بأن تطالب السنغال باتخاذ جميع الخطوات التي بوسعها اتخاذها لإبقاء السيد حسين هبري تحت سيطرة ورقابة السلطات القضائية في السنغال لتطبيق حكم القانون الدولي الذي طلبت بلجيكا الامتثال له.

The Assembly : TAKES NOTE of the briefing by President Abdoulaye Wade of Senegal and President Olusegun Obasanjo, the outgoing Chairperson of the African Union, on the Hissène Habré case and reiterates AU's commitment to fighting impunity in line with the relevant provisions of the Constitutive Act;
1 - يحيط علما بالإحاطة التي قدمها فخامة الرئيس عبد الله واد، ورئيس السنغال وفخامة الرئيسي أولوسيجون أوباسانجو، الرئيس الذي انتهت مدة رئاسته للاتحاد الأفريقي بشأن قضية حسين هبري ويكرر تأكيد التزام الاتحاد الأفريقي بمحاربة الإفلات من العقوبة طبقا للأحكام ذات الصلة من القانون التأسيسي؛

7. The Committee takes note with satisfaction of the information provided by the delegation on cooperation with the Extraordinary African Chambers established within the courts of Senegal to try Mr. Hissène Habré.
7- وترحّب اللجنة بالمعلومات المقدمة من الوفد بشأن التعاون مع الغرف الأفريقية الاستثنائية التابعة للمحاكم السنغالية والمنشأة لأغراض محاكمة السيد حسين هبري.

Some traditional military authorities run private prisons and use the same methods as the political police under the regime of former dictator Hissein Habré.
وتتخذ بعض السلطات العسكرية والتقليدية سجوناً خاصة وتستخدم نفس أساليب الشرطة السياسية للنظام السابق للديكتاتور حسين هبري(22).
