When letters of credit, or other means of commercial financing are used to transfer funds between countries in a manner inconsistent with the client's usual commercial activity, banks must scrupulously carry out the following actions:

Eleject seeks compensation in the amount of USD 379,712 for financial losses, which includes USD 288,135 for expenses incurred on renewing letters of guarantee and letters of credit, and USD 91,577 for losses suffered due to delayed payments.

As evidence of its claim for financial losses, Eleject provided a large number of documents supporting the payment of fees on letters of guarantee and letters of credit.

Apparently, Enka has maintained these letters of guarantee since the abandonment of the Project, allegedly because of a refusal by the Employer formally to suspend any indemnity obligations Enka might owe to it.
