The Committee has also expressed concerns related to the practice of requesting diplomatic assurances in cases of extradition that may expose individuals to the risk of torture or cruel, inhuman and degrading treatment or punishment in the requesting State.

Ms. Ajamay (Norway) asked the Special Rapporteur to elaborate on the criteria for assessing whether there were substantial grounds for fearing that a person returned to a country would be at risk of torture or ill-treatment and, in particular, whether the term " substantial grounds " referred to a specific or a general risk of torture or ill-treatment.

Since 11 September 2001, some States have reportedly extradited, expelled, deported, or otherwise transferred foreigners, some of them asylum-seekers, suspected of terrorism to their country of origin or to other countries where they allegedly face a risk of torture or ill-treatment, in disregard of the principle of non-refoulement.

In his report (A/59/324), the Special Rapporteur on the question of torture suggested some factors to consider in determining whether a risk of torture or ill-treatment exists.
59- وقد اقترح المقرر الخاص المعني بمسألة التعذيب في تقريره (A/59/324)، بعض العوامل التي ينبغي أخذها في الاعتبار لتحديد ما إذا كان خطر التعذيب أو المعاملة السيئة قائماً.

(h) The need for evaluations and continuing assessments of whether a risk of torture or other illtreatment results from official counterterrorism measures;

4.25 The author describes as " one-sided " the Government's general competence in matters of national security in connection with an application for asylum, even if the individual faces a risk of torture or other cruel or inhuman punishment, the death penalty or other persecution.

Secondly, the Immigration Service merely relied on an assessment made by the Ministry for Foreign Affairs concerning the risk of double jeopardy in Uganda and an amnesty for supporters of former President Amin to conclude that the author would not face a risk of being tortured or ill-treated upon return to Uganda.

He expressed concern that Albania's report to the United Nations Counter-Terrorism Committee on measures taken pursuant to Security Council resolution 1373 (2001) did not provide specific information on any provisions to prevent refoulement when there was a threat of torture or use of the death penalty in the country of origin.
39- وأعرب عن قلقه لأن تقرير ألبانيا إلى لجنة الأمم المتحدة لمكافحة الإرهاب بشأن التدابير المتخذة عملاً بقرار مجلس الأمن 1373(2001) لا يقدم معلومات محددة عن أي أحكام لمنع الإبعاد في الحالات التي يوجد فيها خطر التعذيب أو اعتماد عقوبة الإعدام في البلد الأصلي.
