5.1 On 22 June 2009, the complainant reiterated that he would be at risk of being tortured if returned to Ethiopia, since the Ethiopian authorities closely monitored and recorded the activities of political opponents abroad.
5-1 في 22 حزيران/يونيه 2009، أكد صاحب البلاغ من جديد أنه سيواجه خطر التعذيب في حالة عودته إلى إثيوبيا نظراً لأن السلطات الإثيوبية تتابع عن كثب جميع أنشطة المعارضين السياسيين في الخارج وتسجلها.

This Convention, however, does not refer to the non-refoulement obligation resulting of the State party's adherence to the Convention against Torture, and its provisions cannot release the State party from its obligations not to return an individual if a risk of torture exists in the receiving State.
ولكن هذه الاتفاقية لا تشير إلى التزام عدم الرد الناجم عن انضمام الدولة الطرف إلى اتفاقية مناهضة التعذيب، ولا يمكن لأحكامها أن تعفي الدولة الطرف من التزاماتها بعدم إعادة فرد ما في حالة وجود خطر التعذيب في الدولة المستلِمة.

٣٧٢ - وفيما يتعلق بالمادة ٣ من الاتفاقية، التُمس إيضاح بشأن تنفيذها فيما يتعلق باﻷساليب التي تستخدمها الدولة الطرف لتقييم خطر التعذيب في البلدان اﻷخرى التي قد يجري تسليم أي شخص اليها.

4.15 In the light of the foregoing considerations the State party concludes that the complainant does not run the risk of being tortured if he is returned to the Islamic Republic of Iran.
4-15 وبالنظر إلى مجموع الاعتبارات السابقة، تخلص الدولة الطرف إلى أن صاحب الشكوى لا يواجه خطر التعذيب في حال العودة إلى إيران.

In the Committee's view, the first complainant has failed to adduce sufficient evidence about the conduct of any political activity in Switzerland of such significance that would attract the interest of the Yemeni authorities, nor has he submitted any other evidence to demonstrate that the authorities in his home country are looking for him or that he would face a personal risk of being tortured if returned to Yemen.
وفي رأي اللجنة، فإنّ صاحب الشكوى الأول لم يقدم أدلة كافية على تنظيم أي نشاط سياسي في سويسرا يبلغ درجة من الأهمية يصبح معها صاحب الشكوى محل اهتمام السلطات اليمنية أو أية أدلة أخرى تثبت أن السلطات في وطنه تبحث عنه أو أنه سيواجه شخصياً خطر التعذيب في حال إعادته إلى اليمن.

5.3 Counsel notes that the complainants' extradition took place on the basis of the Minsk Convention, which, however, does not refer to the non-refoulement obligation arising from the State party's adherence to the Convention against Torture, and its provisions cannot release the State party from its obligations not to return an individual if a risk of torture exists in the receiving State.
5-3 وتشير المحامية إلى أن طرد أصحاب الشكوى تم على أساس اتفاقية مينسك التي لا تشير إلى الالتزام بعدم الرد الناجم عن انضمام الدولة الطرف إلى اتفاقية مناهضة التعذيب، ولا يمكن لأحكام هذه الاتفاقية أن تعفي الدولة الطرف من التزاماتها بعدم إعادة فرد ما في حالة وجود خطر التعذيب في الدولة المستقبلة.
