If a State Party finds that another State Party is acting in violation of the Convention, it may lodge a complaint with the Security Council of the United Nations, which shall in turn decide whether or not to launch an investigation.
ولأية دولة من الدول الأطراف ترى في تصرف أية دولة أخرى من الدول الأطراف انتهاكاً للاتفاقية أن تقدم شكوى إلى مجلس الأمن بالأمم المتحدة الذي يقوم بدوره بالفصل في مسألة إجراء التحقيق أو عدم إجرائه.

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences under this Convention may be transferred if the following conditions are met:
1 - يجوز نقل الشخص المحتجز في إقليم دولة طرف، أو الذي يقضي مدة حكمه في إقليمها، والمطلوب وجوده في دولة أخرى من الدول الأطراف لأغراض تحديد الهوية أو الشهادة أو المساعدة بأي شكل آخر في الحصول على الأدلة اللازمة للتحقيق في الجرائم أو المحاكمة عليها بموجب هذه الاتفاقية، إذا استُوفي الشرطان التاليان:

1. A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of testimony, identification or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences under this Convention may be transferred if the following conditions are met:
1 - يجوز نقل الشخص المحتجز في إقليم دولة طرف، أو الذي يقضي مدة حكمه في إقليمها، والمطلوب حضوره في دولة أخرى من الدول الأطراف لأغراض الشهادة أو تحديد الهوية أو المساعدة بأي شكل آخر في الحصول على الأدلة اللازمة للتحقيق في الجرائم أو المحاكمة عليها بموجب هذه الاتفاقية، إذا استُوفي الشرطان التاليان:

Amendments shall enter into force for each State Party to the Convention accepting the amendments upon their acceptance by a majority of the States Parties to the Convention and thereafter for each remaining State Party to the Convention on the date of acceptance by it.
وتصبح التعديلات نافذة بالنسبة لكل دولة تقبلها من الدول الأطراف في الاتفاقية متى نالت قبول أغلبية الدول الأطراف في الاتفاقية، وبعد ذلك تصبح نافذة، بالنسبة إلى كل دولة أخرى من الدول الأطراف في الاتفاقية، ابتداء من تاريخ قبول هذه الدولة لها.

" (1) Any State Party to this convention which finds that any other State Party is acting in breach of obligations deriving from the provisions of the Convention may lodge a complaint with the Security Council of the United Nations.
" 1- لأية دولة من الدول الأطراف في هذه الاتفاقية ترى في تصرف أية دولة أخرى من الدول الأطراف خرقاً للالتزامات المترتبة عليها بموجب أحكام هذه الاتفاقية أن تقدم شكوى إلى مجلس الأمن بالأمم المتحدة.

" A State Party which has reason to believe that another State Party is not fulfilling the obligations incumbent upon it pursuant to this Agreement or that another State Party is interfering with the rights which the former State has under this Agreement may request consultations with that State Party.
" يجوز لكل دولة طرف، يكون لديها سبب من الأسباب يحملها على الاعتقاد أن دولة طرفاً أخرى لا تفي بالالتزامات المفروضة عليها بموجب هذا الاتفاق أو أن دولة أخرى من الدول الأطراف تعترض على ما للدولة الأولى من حقوق بموجب هذا الاتفاق، أن تطلب إجراء مشاورات مع هذه الدولة الطرف.

Any State Party to the Treaty may propose amendments to this Treaty. Amendments shall enter into force for each State Party to the Treaty accepting the amendments upon their acceptance by a majority of the States Parties to the Treaty and thereafter for each remaining State Party to the Treaty on the date of acceptance by it.
يجوز لأية دولة من الدول الأطراف في المعاهدة اقتراح إدخال التعديلات عليها وتصبح التعديلات نافذة، بالنسبة إلى كل دولة تقبلها من الدول الأطراف في المعاهدة، فور نيلها قبول أغلبية الدول الأطراف في المعاهدة، وتنفذ بعد ذلك بالنسبة إلى كل دولة أخرى من الدول الأطراف في المعاهدة، ابتداء من تاريخ قبول هذه الدولة لها.

Any State Party to the Agreement may propose amendments to this Agreement. Amendments shall enter into force for each State Party to the Agreement accepting the amendments upon their acceptance by a majority of the States Parties to the Agreement and thereafter for each remaining State Party to the Agreement on the date of acceptance by it.
يجوز لأية دولة من الدول الأطراف في الاتفاق اقتراح إدخال تعديلات عليه ويبدأ نفاذ التعديلات، بالنسبة إلى كل دولة تقبلها من الدول الأطراف في الاتفاق، فور نيلها قبول أغلبية الدول الأطراف في الاتفاق، وبعد ذلك تصبح نافذة، بالنسبة إلى كل دولة أخرى من الدول الأطراف في الاتفاق، ابتداء من تاريخ قبول هذه الدولة لها.

" (1) Any State Party to this convention which finds that any other State Party is acting in breach of obligations deriving from the provisions of the Convention may lodge a complaint with the Security Council of the United Nations.

Such a complaint should include all possible evidence confirming its validity, as well as a request for its consideration by the Security Council.
" (1) لأية دولة من الدول الأطراف في هذه الاتفاقية ترى في تصرف أية دولة أخرى من الدول الأطراف خرقاً للالتزامات المترتبة عليها بموجب أحكام هذه الاتفاقية أن تقدم شكوى إلى مجلس الأمن بالأمم المتحدة.وينبغي أن تتضمن هذه الشكوى جميع الأدلة الممكنة لإثبات صحتها، وأن تتضمن كذلك طلب نظر مجلس الأمن فيها.

8. The Final Declarations of the First and Second Review Conferences confirmed that this article " provides for any State Party, which finds that any other State Party is acting in breach of its obligations under the Convention, to lodge a complaint with the United Nations Security Council and under which each State Party undertakes to co-operate in carrying out any investigation which the Security Council may initiate. "
8- وأكد الإعلانان الختاميان للمؤتمرين الاستعراضيين الأول والثاني على أن هذه المادة " تنص على أن لأية دولة من الدول الأطراف ترى في تصرف أية دولة أخرى من الدول الأطراف خرقاً للالتزامات المترتبة عليها بموجب أحكام الاتفاقية أن تقدم شكوى إلى مجلس الأمن بالأمم المتحدة وتتعهد كل دولة من الدول الأطراف بموجبها بأن تتعاون في تنفيذ أي تحقيق قد يجريه مجلس الأمن " ().
