Today, there are 108 States parties to the Rome Statute.

With the entry into force of the Rome Statute for Suriname and the Cook Islands on 1 October 2008, there will be 108 States parties to the Rome Statute.

As of May 2005, three States parties to the Rome Statute have referred situations to the Office of the Prosecutor of the ICC - the Central African Republic (2005), the Democratic Republic of the Congo (2004) and Uganda (2004).
