On 7 April, the Council unanimously adopted resolution 1595 (2005), establishing an international independent investigation Commission to investigate the assassination of former Lebanese Prime Minister Rafik Hariri, and calling on all States and parties to cooperate with the Commission fully.

The Commission has continued its investigation into the killing of former Lebanese Prime Minister Rafik Hariri and 22 others (Hariri investigation) and has reinforced the level of technical assistance it provides to the Lebanese authorities in their investigation of certain other attacks perpetrated in Lebanon since 1 October 2004.

28. With respect to the allegation of detention of the persons mentioned in the communication, the Government states that they are not detained but on remand in custody as suspects in the case relating to the assassination of the former Lebanese Prime Minister, Rafiq Hariri, in application of the Code of Criminal Procedure of Lebanon, which allows the suspects to be remanded in custody.
28- وفيما يتعلق بادعاء احتجاز الأشخاص المذكورين في البلاغ، تذكر الحكومة أنهم غير محتجزين وإنما موضوعون قيد الحبس الاحتياطي كمشتبه فيهم في القضية المتعلقة باغتيال رئيس الوزراء اللبناني السابق رفيق الحريري، تطبيقاً لقانون الإجراءات الجنائية اللبناني الذي يسمح بالحبس الاحتياطي للمشبه فيهم.

On 16 March, Serge Brammertz, Commissioner of the International Independent Investigation Commission investigating the assassination of the former Lebanese Prime Minister, Rafik Hariri, presented the third report of the Commission (S/2006/161, annex) at a public meeting of the Council.
