1. Subject to paragraph 3, where the law requires that any action referred to in article 16 be carried out in writing or by using a paper document, that requirement is met if the action is carried out by using one or more data messages.

٦ - إذا انطبقت قاعدة قانونية اجباريا على عقد لنقل البضائع يتضمنه مستند ورقي أو يثبته مستند ورقي، لا يجوز عدم تطبيق تلك القاعدة على هذا العقد لنقل البضائع الذي تثبته رسالة بيانات واحدة أو أكثر لمجرد أن العقد تثبته رسالة أو رسائل البيانات هذه بدلا من أن يثبته مستند ورقي.

10. Mr. DONG Yi (China) wondered whether the use of the words " by any means which includes the use of one or more data message " meant that the paragraph was intended to be applicable to means other than data messages.

6. If a rule of law is compulsorily applicable to a contract of carriage of goods which is in, or is evidenced by, a paper document, that rule shall not be inapplicable to such a contract of carriage of goods that is evidenced by one or more data messages by reason of the fact that the contract is evidenced by such data message or messages instead of by a paper document.

" (3) Where one or more data messages have been used to effect any of the actions in paragraph (1) (f) or (g) of this article, and a paper document is subsequently to be used to effect any such action, no such paper document is effective for the purpose of any rule of law mentioned in paragraph (4) of this article, unless:

Such a substitution shall not affect the rights, or relieve the obligations, of the parties involved.

Mr. MAZZONI (Italy) proposed that, after the words " one or more data message " , the remainder of paragraph 4 should be amended to read " provided that the method used to effect such conveyance is reliable enough as to designate as beneficiary of such conveyance the intended person only and no other person " .
