57. The Government informed the Special Rapporteur on 28 August 1996, that Rachid Mesli had not been abducted, but that he had been interrogated on 31 July 1996 by security forces in the context of cases relating to terrorism and subversion.
٧٥- وأبلغت الحكومة المقرر الخاص بتاريخ ٨٢ آب/أغسطس ٦٩٩١ بأن السيد رشيد مسلي لم يختطف بل قامت قوات اﻷمن باستجوابه بتاريخ ١٣ تموز/يوليه ٦٩٩١ في إطار بعض القضايا المتصلة باﻹرهاب والتخريب.

On 10 August, Rachid Mesli was allegedly brought before a magistrate, at which time he is said to have appeared in poor physical condition, with bruises on his right eye and hand.

Rachid Mesli was charged with belonging to a terrorist group (articles 86 and 87 (bis) 3 of the Penal Code), and during the trial both the prosecutor and his lawyers referred to this charge only.
وأدين رشيد مسلي بتهمة الانتماء إلى منظمة إرهابية (المادتان 86 و 87 (مكرراً) 3 من قانون العقوبات)، ولم يتناول النائب العام ومحامي السيد مسلي إلاَّ هذه التهمة أثناء المحاكمة.

Unfortunately, the source, in further comments dated 2 March 1999, merely reiterates the belief that Rachid Mesli is a prisoner of conscience, without providing any other elements which would serve to demonstrate that the detention of Mr. Mesli is attributable to his work as a human rights advocate.
ولكن، مع الأسف، اكتفى المصدر، في تعليقاته الإضافية المقدمة بتاريخ 2 آذار/مارس 1999، بتكرار اعتقاده بأن رشيد مسلي سجن لأسباب وجدانية، ولم يقدم أي عناصر أخرى قد تفيد في إثبات أن اعتقال السيد مسلي تم بسبب نشاطه كمناصر لحقوق الإنسان.

15. In the light of the foregoing, the Working Group, in accordance with paragraph 17 (d) of its working methods, has decided to shelve the case of Mr. Rachid Mesli provisionally, since it is not able to obtain sufficient information on the case.
15- وفي ضوء ما تقدم، قرر الفريق العامل، عملاً بالفقرة 17(د) من أساليب عمله، أن يحفظ قضية السيد رشيد مسلي مؤقتاً، حيث إنه لم يتمكن من الحصول على معلومات كافية للبت فيها.

Furthermore, Rachid Mesli submitted the petition in his capacity as a lawyer, when he no longer practises as a lawyer in Algeria, having been disbarred by the disciplinary board of the Bar Association of the TiziOuzou region on 3 October 2002.
وعلاوة على ذلك، قدّم رشيد مسلي العريضة بصفته محامياً في حين أنه لم يعد يُمارس مهنة المحاماة في الجزائر منذ أن فُصل منها بقرار المجلس التأديبي التابع لنقابة المحامين في منطقة تيزي وزو بتاريخ 3 تشرين الأول/أكتوبر 2002.

The State party also points out that an international arrest warrant (ref. No. 17/02) for Rachid Mesli has been issued by the investigating judge of the Sidi M'hamed court for his involvement in allegedly terrorist activities carried out by the Groupe Salafiste de Prédication et de Combat (Salafist Group for Preaching and Combat) (GSPC), which is on the list of terrorist organizations drawn up by the United Nations.
فبتقديم نفسه بأنه محام، يكون رشيد مسلي قد انتحل صفة زوراً وادعى أيضاً أنه يمارس مهنة لا يمارسها.وأخيراً تذكر الدولة الطرف أن هناك أمراً دولياً بالقبض عليه أصدره قاضي التحقيق في محكمة سيدي محمد ويحمل رقم 17/02 لتورطه في أنشطة يعتقـد أنها أعمال إرهابية قامت بها الجماعة السلفية للدعوة والقتال، وهي منظمة مدرجة في قائمة المنظمـات الإرهابيـة التي وضعتها الأمم المتحدة.
