4- يتعين على كل دولة طرف أن تكفل مراعاة محاكمها أو سلطاتها المختصة الأخرى خطورة الجرائم المشمولة بهذه الاتفاقية لدى النظر في امكانية الافراج المبكر أو المشروط عن الأشخاص المدانين بارتكاب تلك الجرائم.

7- لأغراض هذه المادة والمادة 55 من هذه الاتفاقية، تخوِّل كل دولة طرف محاكمها أو سلطاتها المختصة الأخرى أن تأمر بإتاحة السجلات المصرفية أو المالية أو التجارية أو بحجزها.

ويرد في الفقرة (6) من المادة 12 من الاتفاقية ما يلي " تخول كل دولة طرف محاكمها أو سلطاتها المختصة الأخرى أن تأمر بإتاحة السجلات المصرفية أو المالية أو التجارية أو بحجزها.

(e) The draft OAU/AU Convention on Combating Corruption in article 15 provides for measures to endow its courts or other competent authorities to order the confiscation or seizure of bank, financial or commercial documents with a view to implementing this Convention.
(ه) وتنص المادة 15 من مشروع اتفاقية منظمة الوحدة الأفريقية/الاتحاد الأفريقي بشأن مكافحة الفساد، على اتخاذ تدابير تُخوِّل لمحاكم الدول الأطراف أو سلطاتها المختصة الأخرى إصدار أوامر بمصادرة السجلات المصرفية أو المالية أو التجارية أو بحجزها بقصد تنفيذ هذه الاتفاقية.

6. In considering requests pursuant to this article, the requested State may refuse to comply with such requests where there are substantial grounds leading its judicial or other competent authorities to believe that compliance would facilitate the prosecution or punishment of any person on account of his race, religion, nationality or political opinions, or would cause prejudice for any of those reasons to any person affected by the request.
6 - لدى النظر في الطلبات الواردة عملا بهذه المادة، يجوز للدولة المتلقية الطلب أن ترفض الاستجابة لهذ الطلبات عندما تكون هنالك دواع أساسية تدفع سلطتها القضائية أو سلطاتها المختصة الأخرى الى الاعتقاد بأن من شأن الاستجابة لهذه الطبات أن ييسر ملاحقة أي شخص أو معاقبته بسبب عرقه أو دينه أو جنسيته أو آرائه السياسية، أو أن يلحق ضررا، لأي سبب من هذه الأسباب، بأي شخص يمسه الطلب.
