79- وتقتضي الفقرة 10 من المادة 16 أن تقوم الدولة الطرف التي رفضت تسليم شخص بسبب الجنسية بإحالة القضية إلى سلطاتها المختصة بقصد الملاحقة.

A State Party in whose territory an alleged offender is found, if it does not extradite such person in respect of an offence to which this article applies solely on the ground that he or she is one of its nationals, shall, at the request of the State Party seeking extradition, be obliged to submit the case without undue delay to its competent authorities for the purpose of prosecution.
10- اذا لم تقم الدولة الطرف التي يوجد الجاني المزعوم في اقليمها بتسليم ذلك الشخص فيما يتعلق بجرم تنطبق عليه هذه المادة، لسبب وحيد هو كونه أحد مواطنيها، وجب عليها، بناء على طلب الدولة الطرف التي تطلب التسليم، أن تحيل القضية دون ابطاء لا مسوغ له الى سلطاتها المختصة بقصد الملاحقة.

The Convention is based on the principle of aut dedere, aut judicare, which means that any State party in whose territory an alleged offender is present is under an obligation either to extradite that person or to submit, without exception whatsoever and without undue delay, the case to its competent authorities for the purpose of prosecution.
وتقــوم الاتفاقية على مبدأ " إما المحاكمــة أو التسليم " ، الذي يلزم الدولة الطرف التي يكون المدعى ارتكابه الجريمة موجودا في اقليمها بأن تقوم بتسليمه أو أن تعمــد دون أي استثنــاء كــان ودون أي تأخير لا داعي له إلى عرض القضية على سلطاتها المختصة بقصد المحاكمة.
