Each item in the draft was based on the experience of indigenous peoples and was the product of substantial compromise on their part and, as such, could only provide a minimum standard of protection of rights. The draft did not create special rights for indigenous peoples but at least corrected the fact that existing human rights instruments had failed to protect the rights of indigenous peoples.
